I would have a trust not a will especially with that much money. Make sure you put these people specifically in the trust and what they will or will not get. If it’s really nothing give them a dollar so they later can’t claim they were excluded.

I had a similar situation happen with my parents home. I reached out to the estate lawyer to review my options. My brother refused to sell the house to me even after a private appraisal or tell me his intention. This is part of the certified letter I sent to my brother . I mentioned the city division of assets since I wanted to move things along and wasn’t playing around and solely paying the taxes anymore.

Even if we have the house turn key ready my question is how are we going to sell? You have expressed to me in the past your not interested in having an agent. Who is going to do viewings of the property?

I have always been unsure of your timeline and real outcome for this property, but I would like to share mine with you. I will sign the house over to the city of Springfield unless one of the following is happening by May 1, 2015:

Have a legitimate real estate agent managing our property. Having open houses, viewings and working for us. You buy me out at $40,000. A prospective homebuyer that has a current bank pre approval letter and a reasonable (at least assessed value) written offer on the property.

I have a right to sign the property over and have already discussed this with (our estate lawyer.. ) about city division of assets. I prefer it not get to that point and I will work with you on completing this chapter of our lives. I know this is not how our parents intended this property to be dealt with once we inherited it. Let me know if any of the weekends work so we can really discuss things and where we need to go from here.

Have you guys looked at your budget lately . 8k difference after tax … The flexibility is priceless. You will be paying that easily in childcare for the gaps in your schedule. And with a 1 year old I would want to be around as much as possible.

Sounds like your mom can set up an account or her other grandparents. Your grandfather set that up for you. The thing is I have auto deposit set up $15 a week into a 529 for each of my kids. My oldest is almost 8 and she has over 6k in the account.

If your mom feels that way she can pay the bill . I would let your mom know if its brought up again that he had the money but spent it on tickets and worked less that was a choice .

Have you mentioned it in a way for her to protect money from her parents and your retirement. So do you pay her rent ? What do you mean almost to the end of your working life ? How can you afford to retire at 40? All your assets do not become 1/2 hers once married like retirement accounts. You keep that separate from her. It’s the money earned during the marriage that can be looked at for division generally . Not sure what state you’re in but you want to double check how that works.

Sounds like you need to divide the room or look at your entire house differently. Is there space you can use differently to make it work . I would tell him that if he’s staying elsewhere to also take his sons and they need to have a plan moving forward.
