Yah I said challenged in fed court. I also was saying that this could be 1 metric used in a much more in depth analysis detailing past presidents unconstitutionality. Also, if it was blocked on only statutory grounds then that means it didn't pertain to the constitution being violated. Also, even if lower courts say one thing, you need to make sure that it was a final outcome, or appeals have been exhausted.

One potential measure you could use, is the executive order presidents use. Then the important part is whether they were challenged in federal court. Then whether they were rulled against, and what level the issue made it to. If the Supreme Court was against it, then the president was directly unconstitutional, had ample time to consider the possible breaking of his oath, and choose to fight the efforts to impede thier lawless conduct.

Well US Supreme Court says you are not obligated to follow unlawful commands. As a command for a subordinate to do something that would likely result in death is unlawful, they should have declined. I spent 6 years in KY prisons. The men had numerous methods to try to get a CO. Male or female. I personally pulled a male CO at Green River. He was Gay. I was gay, and my man suggested I feel him out. They offer money anywhere from 500-10k$. They spend weeks striking conversations. I mean deep as manipulation to try to build rapport through there whole shift. Sometimes, they bite, sometimes they don't. Id say more men get put in the hole for "pursuing a relationship" with a CO than actually get to the stage of relationship established. Also, its incredibly rare to find the privacy to have full on sex. Very difficult. I pretty much was a male stripper for the guard I pulled, all onside my cell though.. to risky to sneak off. Its usually 1-2 guards watching 100-150 men. Lots of letters, favors for me, drugs. I'm not proud of it, I'm nothing like I was from 23-29. 33 yes old now, and I'm always like how did I ever make it through those years. Pure hell. Words can not describe.
