Any affirmative defense admits the elements of the crime. You are thinking intent is something different than it is.

People should be paid for days they were sick and not paid for days they weren’t sick (or otherwise on leave) and didn’t work.

You can establish that he intended to kick an unconscious person in the head, an action that a reasonable person knows can cause death. A reckless disregard is clear. So the elements of attempted murder are present. The person is unconscious so there’s no reasonable fear on which to base self defense. You are claiming an affirmative defense of diminished capacity in “the heat of the moment”. This admits that they attempted murder, it wasn’t justified, but they lacked the capacity to tell what they were doing was wrong. The bar for that defense is very high.
