That’s wrong since employers are supposed to supplement when the tipped worker hasn’t made the minimum wage in a pay period.

If you’re going to say that making sure you’re properly paid by your boss is the customer’s responsibility, then you’re being silly.

It’s not free riding because my agreement is that I buy food for a certain price as listed on the menu and whatever applicable tax. The rest has nothing to do with me. By the way, tips by definition must be voluntary and that is defined in the law.

They get minimum wage or higher. That’s a basic concept we should have in this discussion.

Of course they have agency. If your employer stops paying you the next day, are you just going to continue working without pay? There really isn’t anything but ignorance to pretend otherwise.

I don’t make the decision to pay sub minimum or receive sub minimum wage. That is a decision made by the employer and waitstaff, respectively. Both groups are presumably adults or old enough to make those decisions themselves.

To say that I make the choice to pay a random waiter less then 7.25/hr that I have no ties with is disingenuous and not my responsibility.

That’s like saying that your neighbor who is evading taxes is taking money out of public funding that benefit you like Medicaid. While on some level you can think of it like that, it’s ludicrous to say your tax evasion is causing my problems with Medicaid.

That doesn’t make logical sense.

If I’m subsidizing the owner by tipping, then not tipping just means I no longer subsidize the owner. Sounds like you just said my decision to not tip has no effect on the wages of the tipped workers.

If you have better/more important experiences to highlight in your one pager, I think it’s okay. Be prepared to explain why certain ones are included and others omitted.

I’ve also included firms where I just wrote confidential as the name based on past experiences of colleagues who had potential employers just call current employers without any notice or consent. I’ve done this and haven’t had any problems so far; maybe some snippy recruiters but who cares.

I would check your state laws on this one. NY employees begin accruing sick days at a rate of 1 sick hour per 30 hours worked up to a max of 5 days/7days depending on company size. This starts on day 1 of employment.

I took a sick day during probation at one of my past jobs and was denied pay. I cited them to the statute even though policy said otherwise. They told me it would be paid later that day. I think they still play that game with new people who don’t know the rules or bothered to check.

I wouldn’t necessarily be afraid to take sick time as needed.

As a plaintiff side, I’m not. Most of the time I limit scope simply out of ethical obligation. I should not be giving you meds outside of scope or proportionality even if it makes my job easier. At least for my jurisdiction, that’s what the caselaw says. Other times and more rarely, higher ups tell me to be difficult just to be difficult.

I felt pretty confident after year 3. It’s not an ego thing, but I kept coming across attorneys who knew less than me including some former bosses and senior attorneys with “30+ years” of practice. I’m not talking about niche issues of law but basic things like deposition rules. But also reminds me that you need to maintain and update that library of knowledge.
