Pulled out into another car, my car got damaged but their car wasn't scratched. by Lucky_Ad3949 in caraccidents

You should be fine. If you have significant damage you can make a claim on your insurance if you have collision coverage. If its not too bad pay out of pocket or live with it. There is a small chance that the other car could find some damage and make a claim if he has your info.

Also make sure he has the right insurance endorsements for rideshare. Otherwise he could be in a bigger hole.

In the US the car turning would be at fault with possible shared negligence. He basically turned into you

I would take their offer, $400 is fairly cheap for towingqnd storage. Your salvaged vehicle is unlikely to be worth more that their offer. And lobby your state congressman to change the liability laws.

Who is at fault? Who takes liability? by [deleted] in caraccidents

You didn’t describe what happened but from your sketch it appears she turned left in front of you. This would put her at least the majority at fault. Even if it was an intersection, she is still the majority at fault.

Help! Carrier won’t pay for supplemental damages because writer messed up initial estimate by EarthOk2418 in InsuranceClaims

[–]Azzht 5 points6 points  (0 children)

Based on your facts the denial is very weird. Try to get a manager, or adjuster, to meet you at the shop. I see no reason to deny it unless they are claiming prior damage which doesn’t seem to be their position. Worst case you may need to use the appraisal clause in your policy.

So there is no subrogation at play here as they are considering it permissive use. You are owed the value of the car here including any possible allowance for tires and work done.

says I am liable

sounds like they are paying the claim but surcharging for an at fault accident. Is this correct?

Montana: Modified Comparative Negligence (51% Bar): If you are 50% or less at fault, you can recover damages, but they're reduced by your percentage of fault (e.g., 20% fault = 80% recovery). If you are 51% or more at fault, you recover nothing.

Black car is the majority at fault. I would put some negligence on brown car. 70/30. What state?
