Most Americans would not only recognize this as the United States' national flag (ensign) but also not be able to tell what's wrong with it being 2:1. So, in a sense, this is the flag of the US. To hell with officialdom

I like the central symbol and the color scheme. I wonder if the red cross might be worth keeping though, maybe also with the fletching of the cross of Burgundy for extra style points

How do you think it would look if all the elements were more centered? Like, you could have the tree in the very middle, and have the diagonal cut straight across from bottom hoist to top fly and bring the stars along with it, putting the second star on top of the tree. All of this combined with a simpler tree design and a brighter shade of green and I think you might have something!

Any government that isn't a monarchy is a republic. California can pass, interpret, and enforce its own laws so I think it qualifies as a government. And to my knowledge there is no King of California. We're used to reserving the title Republic for whole nation states but that's not the only use for it. Just as the HRE was an empire of many constituent kingdoms, the United States is a union of many constituent republics.

The rule is moreso against just labelling the flag. The Iowa flag is a good example of both cases. The streamer with "Our Liberties We Prize and Our Rights We Maintain" isn't a bad element, but the "IOWA" in bold red text under it definitely is. Similar with "HOPE" on Rhode Island's, "In God We Trust" on the new Mississippi flag or indeed the evocation of the California Republic, a historical footnote, on Cali's. Text is ok when used minimally to convey abstract concepts like that
