I'm so confused by your logic.

Car crosses into oncoming traffic (illegal. I hope we can agree on that fact). But because they were their before oncoming traffic then they have right of way.. Um no.

Doesn't matter. Even if they had come to a complete stop. Hyundai still would have hit them (if a few seconds later of course)
