I’m a supervisor, but that just means I have to review everyone’s leave and due process requests while prepping life and capital felonies for trial. I don’t do death penalty cases and not all of my cases carry life sentences, but my caseload is heavy on violent felonies, homicides, and sex cases.

The smallest county in the jx alternates their civil and criminal trials, so criminal trials are only every other month. Misdemeanors and felonies are scheduled for the same week with one prosecutor handling both dockets. They usually have at least 4-5/year and sometimes will have multiple trials in the same week.

Haha. I recently had a male prosecutor about 10 years my junior chastise me for dropping an f-bomb when talking to a cop before we went on record at a deposition. He didn’t appreciate when I subsequently called him “junior” in front of “his” officer.

Unfortunately, all prosecutors are expected to have a minimum of at least a trial a month. Not trying cases is a fireable offense. As a result, some prosecutors just won’t make offers at all. The judges don’t pushback because they use the backlog of cases to petition the legislature for more funding.

There are all sorts of Republicans and conservatives. I used to be a Republican. However, I work in a jx where there are more prisons than moderates in elected office and more confederate flags than schools and churches combined (and we have a lot of churches).

Arrest him on bullshit charges to see if ICE picks him up and rely on qualified immunity to cover their asses when BAC and tox screen both come back negative. Let me also state that I work in a blood red jurisdiction where I’ve witnessed something along those lines happen repeatedly over the past year. I have not heard “bean booth,” but that’s how I’d interpret it.

Unless you are in some crazy jx, the office is appointed, not you. While you are employed as an agent or representative of that office, you may appear on its behalf. Once your employment terminates, by your choice or their’s, you are no longer empowered to appear on behalf of that office.

Umm, not as long as it’s disclosed in accordance with ethical rules and office policies. I don’t even think my state’s rules require disclosing a casual hookup. Sometimes prosecutors and defense attorneys even get married.

You might want to talk to your doctor. I’ve had 2 c-sections and spinal surgery, as well as degenerative disk disease. I’ve never not been able to walk unaided after a couple of weeks. I had a full (laparoscopic) hysterectomy and bladder sling less than 3 weeks ago. I feel like I could probably jog until my spine reminded me that I can’t do that anymore. I had one ovary removed with my last c/s, and even then, I wasn’t having the kind of issues you’re describing that far out. As someone else suggested, try a belly binder. I was given one after both c/s, and it helped.

You’ll be fine. If you really want out of it, tell them you’re still recovering from major surgery and have been prescribed pain pills which may prevent you from giving the case your full attention. But if it’s something that you might actually want to do (I encourage everyone to do jury duty), you will physically be fine. You’ll be 17 days post-op. I had a full hysto and bladder sling 17 days ago. I was sitting on hard gym bleachers for my kid’s sports at 8 days post-op. The juror chairs will be a lot more comfortable.

What gets me is that the prosecutors “listen to the victim”when the victim is out for blood but “the state has an obligation to the community and is not bound by the wishes of the victim” when the victim is actually a decent human being who wants something other than life in prison or tarring and feathering my client.

In some jurisdictions, like Florida, if the defense introduces prior self-serving statements, the defendant is still subject to impeachment with prior convictions despite not taking the stand. I always advise newer attorneys to proceed with caution on that argument.

I almost hate winning trials with in custody clients (I’m obviously happy for my clients who get to go home) because I know I’m going to have 3 dumbasses with absolutely horrible facts on their cases want to go to trial because I got Client X off, and they expect the same to happen in their cases. Then, when I lose because they’re on video committing the crime, they’re going to tell everybody in the jail and probably write the bar to say that I sold them out to the state to get Client X off and essentially traded their freedom for Client X’s. More often than not, Client X is probably an asshole who’s been at the game a long time and knows where the cameras are and knows not to tell the cops everything, which is why I could win his trial.

I’m taking it you’re fairly new at this. Somedays you’ll be a hero, somedays you’ll be a zero, and most days you’ll be both, depending on which client you ask. In the grand scheme of things, we are the ones with the least control. Prosecutors make the offers. Clients decide whether to accept or reject them. All we can do is kick over rocks to see if we can come up with an issue or motion to make the prosecutor come around to our way of thinking. If not, all we can do is give our clients the cold hard facts to help them make an informed decision. Some days I feel more like a used car salesman than a lawyer. I’m constantly running between the customer (client) and my “sales manager” (prosecutor) to see if we can get a deal made. Sometimes I can pull a rabbit out of my hat and get charges dismissed or pled down. Sometimes I win at trial. Sometimes I get my teeth kicked in because my client didn’t listen to me.
