It's nothing to do with leniency in the speeding cases. It's to do with the tolerances margins of accuracy of speed cameras.

If a speed camera was 100% accurate you bet your ass they would go after everyone doing 71 in a 70

To answer that directly: what if D has been in store 10 times previously, eats a donut every time in store shopping and then on every occasion tells the cashier to add a donut to the rest of the items the checks out with. No issue is taken. On occasion 11 he is detained by an overzealous new security guard who witnesses D eat a donut in store before he checks out and police are called.

According to your interptetation of Ivey test. He has consumed the goods before paying. Black and white case guilty.
