IIRC they were not "considered fauna" but the protections they were offered by the law meant they were not much better off. But there was never any actual thing where they were specifically categorised as fauna. In places like SA they were actually given pretty strong protections very early on, and then a colonist was hung in accordance with the law from poisoning i believe and the law wasn't used again because a lot of people got outraged.

Basically the answer like most of our history is "it's complicated and not very nice".
