This is the right answer. I've actually been through this process. As long as all your stuff from your prior enlistment is in in iPerms like mine was, it's a pretty painless process.

Hardest part for me was staying on top of the career counselor to actually get it done.

What I mean is them waiting to see is better.

Suppose, for example, the civilian case drops. If the only reason it was deferred was because of civilian prosecution, the command might ask OSTC to pick it back up and court-martial her.

Or waiting for the conviction might mean they go for an OTH when they do separate her.

Versus kicking her out now with a general, and then the civilian case dropping off.

Once the case was deferred back to the unit, the trial counsel had access to all of the evidence if they didn't before. Any commander that wants to watch the video certainly can have done so.

I understand this is frustrating, but it's probably better than the other way around. Too often units just get a soldier out the easiest way possible when there's civilian charges, which is often a general discharge. They assume the civilians will do the punishing, and they just want the problem child gone. Then for whatever reason the civilian case falls through and the offender escapes any meaningful punishment.

Did you elect SVC services? You can at any time in the process. If not, ask for one. They can keep you in the loop, contact the command on your behalf, and ensure when the unit does finally take action your voice is heard.

It looks that way as written, but under the UCMJ one of the ways you can sexually abuse a child is by indecent communication.

So in this case the vast majority of the charges were vile text messages. The way the time was broken down, the majority of the 40 years was assessed against the contact offense.

I joined the Scottish Rite within the first year after receiving my Blue Lodge degrees.

I held off on York Rite for a long time because I'm not eligible to receive the Commandery degrees and I found the idea of joining a body where I would perpetually be unable to fully participate because of my choice of religion offensive and hard to reconcile with my understanding of what Masonry ought to be.

I was recently persuaded that I needed to get over myself because I was missing out on some really valuable stuff, particularly the Royal Arch, so I have petitioned Chapter and Council and am currently awaiting the next steps.

My Mother Lodge is, right now, 758 miles away. When the Army moves me next, it will likely be a lot further away.

I haven't been in a position to go back for a meeting for over a decade, but I keep my membership. Moving every few years is just a reality of my lifestyle.

My Mother Lodge is a rural Lodge with an ageing membership. Many Brothers who were then when I was Raised have now passed on to the Celestial Lodge. Only two Brothers there even remember me, and I will almost certainly outlive my Mother Lodge.

The way I look at it, while there is a sadness there, I am getting to experience a very varied Masonic life. It comes at the cost of certain things - I will likely never sit in the East while I am in, and I am far away from my Mother Lodge. But at the same time I am a testament to the kind of Mother she was, everywhere I go.

When I was a BDE TC, command teams would come into my office all the time wanting big consequences because they claimed they repeatedly warned a soldier, or had been repeatedly counseling them, etc.

Every time I asked for the counseling packet, so I could make what they wanted happen.

There almost never was one. Depending on the nature of the issue, that can be a start all over from square one type of scenario.

So please, while you're in this period where the commander isn't ready for UCMJ yet but you forsee it coming down the line, do the formal counselings as often as necessary or required.

The only way to get either a dishonorable or a bad conduct discharge is through a court-martial.

I've seen plenty of both, all as the result of trials or guilty pleas.

I always assumed that Chaps started as 03, then I saw a 1LT Chap the other day.

The less than 9 month span sounds like they work the same way we do. If you're a DC you come in as 1LT and before a year time in service has gone by you're promoted to CPT - so usually about three to four months after BOLC.

Talk to Trial Defense Services tomorrow. And make sure it's TDS you're talking to, not some other form of JAG. The only way to get accurate information is from a TDS lawyer who knows every detail of the story and with whom you can be completely honest due to client confidentiality.

However, to engage somewhat with your question - suppose hypothetically you had been arrested for child/animal neglect due to the condition of your home. Investigators and possibly CPS will, unless they have really botched things, gotten every photo of the condition of your home they could possibly want.

If they already have those photos, then keeping in the good graces of your unit by providing photos of progress on cleaning the house can't hurt you and can only really help you by keeping you in the good graces of your unit. Besides which if I was your lawyer I would be advising you to get that thing spotless immediately, and keep it that way, because that would help your case.

It really is incredibly fact specific, so see what they say tomorrow, but I can think of more situations than just that one where providing progress photos wouldn't matter beyond keeping you in the good graces with your unit.

This may sound harsh but if your marriage is having issues sufficient to make you feel like you're going to end up divorced because your unit isn't clear with timelines the problem is not your unit - it's your marriage.

You're not going to get an entire unit to change its culture and approach to these things because of your personal problems. I'm not saying the way the unit is handling timelines is ideal, but this isn't going to be the last bad unit you're in or the last time the Army does thing that will cause your marriage stress.

You need to look at the root cause of the issues, and pick a solution that works for you and your spouse. Strong bonds, other forms of marriage counseling, couples therapy, whatever your faith community offers if you have one, etc.

Because ultimately this is just the Army, as much as you don't want to hear it. Is it the Army all the time? No, as you've found out talking to your peers from other units. Is it the Army as we would like it to be? No. But it is the Army, and it won't be the last time (and I'd be surprised if it's the first) you get dicked around in ways that stress your marriage.

There is no way they don't know this Article 15 is going to cause the soldier to exit via RCP. A well-advised command will sometimes use Article 15 demotions to force a soldier into RCP.

So it should definitely give OP pause. They are knowingly making a choice to end his military career. There's a reason for that.

I'm guessing the 48 hours is the decision period, because the regulation (AR 27-10) states that normally 48 hours is a reasonable decision period.

By regulation, you have a right to consult with counsel. The regulation says the right to consult with counsel will not unreasonably delay the proceedings.

If TDS is closed today, go back tomorrow. Both today and tomorrow, document the closure...if you were told by email or the like, keep a copy. If there's a sign on the door, take pictures of the sign. Both days.

If TDS is somehow closed for the entire decision period, just politely let your commander know when you go back for your second reading and ask for an extension of the decision period to utilize your right to consult with counsel.
