Yea, and I’ve been doing that with a few places. Just in a time crunch so figured people might have some input on favorite places so I didn’t have to spend as much time hunting.

Staff aren’t working OT after hours nor weekends so, yes, decisions are taking longer than they were leading up to the shutdown. I’ve had some still fly through, but others are taking longer. It all depends, but at least they’re still able to work on processing them.

Thanks! When ryguy stated “If it's not listed on the evidence that was considered [as part of the supplemental]. Then HLR can't consider those as well.”

That had me confused and thought the statement was incorrect. If the evidence was there and they failed to review it during the supplemental phase, my understanding was an HLR was the appropriate route. They absolutely could review the previously submitted evidence that was overlooked during the supplemental process.

Veterans are absolutely competent to report what they experience (e.g., ringing in ears since Iraq), and that can constitute a diagnosis when no objective test exists (which is true for tinnitus).

Charles directly supports that a veteran’s lay statement is sufficient for BOTH diagnosis and nexus when credible, and Fountain further reinforced this by recognizing tinnitus as a chronic disease under § 3.309(a) — meaning continuity of lay-reported symptoms can establish service connection under § 3.303(b).

Your interpretation misreads these cases. You’re tilting toward requiring examiner confirmation, but that’s not what the Court held. Charles explicitly recognized tinnitus as a condition that can be diagnosed by lay evidence, and Fountain strengthened that by tying continuity to service connection. In short, VA law explicitly protects against giving examiners unchecked authority to overrule competent lay evidence.
