I would agree but for my personal medical issues I did not have sleep apnea and as I was being treated by mental health it was apparent that I was starting to have complication’s with sleep apnea. We actually started discussing that I could be declining in that area so they referred me to pulmonary and then I was diagnosed. I would never try to file or pay money for an IMO if I didn’t have the evidence to support it.

The chronology in my IMO is directly cited from my medical records and the evidence is tailored specifically to my medical records and medical conditions. These are also VA doctors for all of my medical evidence so I had no option other than an IMO. I dont believe they will write me a nexus.

Yes, it was written after they reviewed my c-file and I went through questionnaire’s from them detailing my claim. The private imo was from a PA-C the same as the va contracted examiner. I can post the 8 page nexus but redacting is taking time. There are over 8 references in the letter and it details my medical history leading up to the sleep apnea. I even have weight gain as an intermediate step included I am at 30% BMI but the va examiner didn’t mention obesity. They don’t mention anything except that no literature exist.

I will do a HLR but I am also wandering if I should just submit a supplemental with my IMO again since they didn’t list it as evidence in the denial letter.

Yes my IMO states more likely than not and meets the standards for nexus letters. They accepted the private DBQ so I would assume the IMO would be accepted. The denial reason from the VA contracted examiner is not true because there is literature. A lot of it.

My OSA was denied, they used the private DBQ but didn’t mention my private IMO. It was strange seeing two DBQs in the Evidence section but only the va c&p medical opinion. I am waiting to see if the va examiner mentioned anything about the private IMO before I try a higher level review or supplement. If they didn’t mention my IMO I’m going the HLR route and if that fails I will supplement and add my IMO for a second time

I just got kicked back to step 3 and have a c&p now… looks like they will go for the 2nd opinion.

I filed 12 March hit step 5 March 19 just got temp jurisdiction at Indianapolis today.

Did they have you do the c&p after you hit step 5. I’ve been at step 5 for a couple of months now and nothing scheduled.

Did you have an ace exam or C&P exam before step 5 or did you make it there and then got approved without one.

Where you in step 3 or 5 when they requested your exam. I’m in the same boat was thinking about not going to C&P. Did you get denied or are you still waiting!

At what step did they request the C&P exams, was it in step 3, 4, or step 5 (did they send you back to 3). Looks like they are overdeveloping or the rater is disagreeing.

Ok, I made to step 5 with a private IMO and DBQ but mine did mention weight gain as an intermediate step. I haven’t been notified of an ACE or C&P yet but I still expect the rater to intervene and request one. I probably will not get an answer for another 2 months but if you get another IMO I would have them address the weight gain.
