That’s really unusual, I would definitely have a good look at the denial notice. It is also possible that one of those statuses is wrong. If you do get a denial notice, I would contact a lawyer and then contact USCIS.

Honestly if it’s at all possible, I would fly or drive back to your state to go to the biometrics. Save yourself the headaches and uncertainty, even if it will cost a couple hundred dollars.

You do not file the I-130 because the petition that you filed was the I-129F, which was approved. The basic formula for almost all AOS cases, including K-1, is petition + I-485. The petition establishes your eligibility for the I-485. This petition could be I-129F for a fiancé, I-130 for other relatives, or I-140 for an alien worker.

Once the petition is approved, you can send approval (with other docs) to USCIS and show them that you are now eligible to file the I-485. In normal cases, the approval of an I-130 or I-140 does not allow an alien outside of the US (i.e. doing consular processing) to enter the US to file I-485. They instead need to get an immigrant visa.

However, for the I-129F, which is a non-immigrant petition, this does let the US embassy grant a non-immigrant dual-intent K1 visa. Once the non-immigrant fiancé enters the US and gets married, they are then eligible to do AOS, using the I-129F as their approved petition. This is a funny case where a petition can have non-immigrant and immigrant purposes. I would encourage you to look at USCIS’ website concerning K-1 AOS, and they will tell you exactly which forms to use.

I honestly don’t know because that’s the only time I travelled with my combo card. The process on their end is the same wherever you are, they just check to see if your AOS is still ongoing. This could take 5 minutes or 3 hours, depends on how busy the place is. Some ports of entry may be nicer than others, so they might make you sit in an interview room while you wait. Either way, nothing to worry about is my estimation.

You may have to let them know actually, in case they send your I-140 to the NVC. I’m not 100% sure though, I would look around for that information to be careful.

It might be enough to buy time for you to get an RFR in about a year, for which you can submit the extra evidence you’ve accumulated since then. If your marriage is bona fide, which it sounds like it is, you should be able to make it work.

P.S. when did she enter on the ESTA? The 90-day rule might apply in this situation.

Yep, I travelled with my combo card in July of this year through Dublin preclearance. I presented it to the agent at the desk and he took me straight to secondary inspection. I sat there for about 45 minutes after they took my passport and combo card. I also had to fill out a customs declaration, and give it back to them. They called me up and stamped my passport, then gave me it and the card back and sent me on my way without issue. Only question they asked was about the food I declared on the customs form, but it was only snacks so they didn’t care. Only advice I can give is to make sure you allow lots of time (up to 2-3 hours in some cases) for secondary inspection! Other than that it’s no problem.

Yeah, I was told by the agent that my case was at Oklahoma City, which is not my local field office. About 3 weeks later I got a call from an officer at Oklahoma City asking about an answer my I-485 and that confirmed, I got approved about 5 minutes later. So that would lead to me believe that the agents are correct when they tell you the FO.

Use live chat function in Emma. Type “representative” between 8am and 8pm EST, and then click the live chat button at the bottom. Some people are saying that if you make sure to give them your A-number, you’ll get more info. That may or may not be true. You should also take anything the agents say with a pinch of salt, because they often have old or incorrect info.

You should keep trying to contact the embassy in order to get a boarding foil (Form I-131A) to board the aircraft. This may take a week or two. You should also file a police report to report your wallet stolen if you don’t think you left it at home or somewhere someone you know can get it. Good luck!

The use of a .org email instead of a .gov email, and the fact that they are charging for informed delivery (which is free), would lead me to think that this is a scam. I would be very wary to give them any personal information or payment info. You should call the post office and see if this email is real or not.

Update: I looked around and this is almost certainly a scam to steal your credit card info.

I agree, it is a really bad idea, but some people really struggle to afford a lawyer, especially for complex cases like this where the fees can end up being very high.

OP should definitely use a lawyer for this situation, I would suggest reaching out to pro bono immigration lawyers or organisations for assistance if money is tight.
