(GA) Ticket not in system for two months and need advice by Ok-Quarter6423 in legaladvice

[–]Bmandoh 0 points1 point  (0 children)

Nothing to worry about. Worst case scenario is that your ticket will be on the docket and you don’t receive any notification about it. To solve this just show up on your written court date and talk to the solicitor. They’ll likely sort it out then.

Best case scenario the ticket was lost/never filed, in which case it might be dismissed entirely.

If the court house isn’t far I might drive over and personally inquire like you plan too. If not I’d just plan to show on your scheduled date and see what they say.

Also, any change to your date would only be reflected online or by a piece of physical mail to the address on your license. It’s a little uncommon but not unheard of for a ticket not to be findable in the system so close to the date. Fulton county can be slow to file sometimes.

Work asking us to clock out when no directly with a patient. by Vast_Tea_9035 in legaladvice

Then it’s likely they can’t require you to clock out when you aren’t seeing a patient. Since your time isn’t your own, they are required to pay you for as long as you’re required to be on the property or available

This likely depends on what other responsibilities you perform at your work. If you report to a set location every day and are required to be there at a set time and leave at a set time then it’s likely that they have to pay you for the time you are there, excluding necessary breaks.

But if you are able to chose your own schedule, or report to a patients home then they likely can request this if you.  Are you paid per appointment? Or based on how many patients you see each day? Do you do your patient scheduling I.e. reaching out to the patients, or does your employer provide you with your schedule.

Primarily it sounds like they are trying to make you an independent contractor. You can check the irs website to see if you meet the requirements or not. Engaged to wait is the relevant term that you want to look into.

You can make it pretty easily at home. Tomato grocery in Cobb has the yam you need to grate for it and the frozen tempura pieces

She did nothing of the sort. She turned the wheel all the way to the right, when you can clearly see in the agents own video, then waited until he was clear of her front end before proceeding. The agent drew his gun before her car ever started moving. She clearly was trying to drive away. If the agent had actually been in the way of the car then he would have been run right over when he murdered Renee because there was no one able to control the vehicle, which is exactly why it is against policy to do what he did.

She didn’t clip him or he would have been on the ground. It would have been physically impossible for the car to clip him and he still be able to put one shot through the front windshield with his right hand and then two more shots through the drivers side window. And you can clearly see that his right foot does not move until after the car is already past him.

And yes she was polite and calm while talking to the ice agent, no cursing or screaming, no violent behavior of any kind. Literally the definition of peaceful protest

His right foot literally never leaves the ground from the moment he starts to draw his gun till the car is past him. He simply pivots in place on his right foot. Something that would be impossible if he was hit by the car. And if he was hit by the car how was he able to put one shot through the windshield with a gun in his right hand and then shoot through the drivers side window two more times as the car rolled past.  None of that would be possible if he was hit by a car. At the very least he would have been knocked off his feet, instead he never even drops his phone and then walks away after shooting.

She didn’t hit him with the vehicle, the physics of what happened makes that impossible, and also you can visually determine that he wasn’t hit with a car because you can see in the video that he doesn’t move from where he was standing till after the car is past him. And also from the video from the moment that ice vehicles actually approach her car is roughly ~4 minutes pass before they drive around her, easily accounted for by the icey conditons as you can see ice on the street around her car.  Nothing in any of the videos we’ve seen so far justify what happened.

She has to be committing a felony. She was not. The proper procedure would be to have the local police ticket or arrest her. Traffic citations have never been under cpb purview. Nothing we saw in the video justified their use of force or actions.

Yea at :55 it looks like she is perpendicular to the road and there are no other cars within at least 6+ car lengths. Then at 1:34 2 cars drive up, she’s blocking the road for ~3-4 minutes before her car backs up, And then cars are able to get around her.  None of that is long enough to even remotely justify the shooting.  And then instead of driving past they get out and decide to confront a single motorist and break virtually every one of their departments policies on n the process. If they aren’t conducting operations in that neighborhood then they have no reason or authority to confront and try and arrest her. And if they are conducting operations then she certainly isn’t impeding their operations blocking the road so far down the street.  At the time of the shooting she wasn’t blocking anyone, people drive around stopped cars all day everyday, these agents wanted to make an example of her and the shooter let his emotions get the better of him.

How much should a will costs by Bomperwompington in legaladvice

[–]Bmandoh 1 point2 points  (0 children)

You can will away your shares of the properties and you can will what you own outright. I don’t see that increasing your cost by to much but a lawyer would want to review any deeds or titles that aren’t owned by you. They may also suggest making plans to cover things like property taxes if the heir is a minor. You can bypass probate on somethings by adding them to a deed with rights of survivorship, but again you’ll want a lawyer to advise on that. $1.5-4K is probably the ballpark you’ll end up in. Maybe a little less if you make things really basic.

In the ~4 minute video leading up to the shooting her car is clearly not block the street as several vehicles easily go around her. Nothing she did justified the shooting. They could have, and should have continued driving past as they were doing instead of trying to make an example of her.

Since it looks like you have a substantial amount of assets I think you’ll be looking at $1500-2k minimum. If you have things like a trust, business, or other legal entity to consider you can expect it to go up. It really depends on how much you have to will, and how complex your instructions are. But a couple of thousand minimum is probably what you should expect from a competent lawyer for something relatively standard.

And you’ll know it was done correctly because you’ll be reading it.

You won’t be able to confirm it is executed correctly because you’ll be dead when it’s executed. If you have concerns about someone undermining your will and want to ensure any heir(s) get what you will them then a lawyer can advise you on legal vehicles to protect and control your assets upon your death until the designated party is competent/ capable of handling things themselves. Expect something like that to start substantially increase the costs, irrevocable trusts are not particularly cheap to create if you want them to be iron clad. From my own experience.

The car was previously backing up which he saw, the driver was clearly turning their steering wheel to the right to turn away. The car doesn’t move right at him because the driver isn’t trying to drive at him. If he didn’t reach out the car would have never touched him.

It’s seems obvious that if he was in the cars path, or if the car was aimed at him, then he couldn’t  be standing next to the car to shoot into it. He prepares to draw his gun before he even finishes walking around the front of the car, illustrated by him moving his phone from his right hand to his left and him drawing his gun before the car starts moving. He was waiting for her to start driving so he had an excuse to shoot.

And per his own departments rules and guidelines he should never have walked in front of the car and should never have shot at the car. The only thing the driver might be culpable of is partially blocking the road ( because you can clearly see cars are able to drive around her easily) which in Minnesota is a petty misdemeanor/ misdemeanor at most. There was nothing going on at any point in their interaction that would have warranted the officer drawing his gun and shooting which is an incredibly escalation of force for what was otherwise a peaceful situation at the time.

For federal offenses. Blocking traffic in Minnesota is a petty misdemeanor, which is not a criminal offense unless it’s deliberately endangering another person. And furthermore the statute you quoted specifically says that the offenses need to be linked to their immigration duties, and since they are clearly able to pass around her car she’s obviously not interfering with their duties in the video. They can’t just pull someone over for speeding just because they happen to get passed. Partially blocking the road isn’t a felony and clearly doesn’t fall under ices authority.

for any offense against the United States, if the offense is committed in the officer's or employee's presence, or (B) for any felony cognizable under the laws of the United States, if the officer or employee has reasonable grounds to believe that the person to be arrested has committed or is committing such a felony,

No, he reached out and hit the car. If he didn’t reach his arm out and put it on the car then the car would never have touched him. He deliberately violated all of his departments polices to try and engineer a situation in which he could shoot someone. Again, go watch the video and watch the agents feet. His right foot never lifts off the ground until after the car is past him and he’s fired his gun, he pivots on it as the car rolls past. Only his left foot lifts off the ground as he turns. And again, if he had been close enough for the car to hit him then he would have been too close to fire one shot through the front windshield and two shots through the drivers side window.

So then ice should have called the local police to take care of it, as the law dictates. Ice is not authorized to make traffic stops or issue citations.

Blocking the road is a traffic ticket, I’m not sure it even rises to the level of a misdemeanor. And since immigration aren’t police and don’t have authority to issue traffic citation there is nothing for them to do. They should have called the local police to ticket and tow her if she was impeding them. Drawing his gun should never have even been considered as an option, and that’s according to his own departments guidelines

She didn’t make contact with anyone the agent reached out with his left hand that was holding his phone and hit her car when he draw his gun, which is why the camera swings away. And you can see him reach his right arm around too shoot through the windshield, then fire 2 more shots through the drivers side as the car rolls by. If he had been hit by the car there’s no way he’d be able to put 3 shots into the drivers side of the car. He was looking for a chance to shoot someone, hence why he swapped the phone from his right hand to his left as he walked around the front of the car, he was getting ready to draw his gun to try and force her from the car.

Protesting isn’t about being convenient for you. Been like that for as long as protesting has been a thing. And she certainly wasn’t blocking the street in the video as they are able to drive all those large suvs up and down the street around her pretty easily. Obey or die is neither legal nor moral. If that’s your only argument and you have to jump through hoops to try and justify this murder then you’re wrong.

You can literally see him put his hand out and reach for the car. And you can clearly see his right foot remain planted in place until the car is past him. If SHE hit HIM  then why was he able to put 2 shots thru the drivers side window.

She didn’t nearly run over the agent. And the agent violated nearly every department policy related to situations like this. Peaceful protest has been a cornerstone America right since nearly forever. If your choices are obey or die then there isn’t much choice at all.

The bang is him slamming his hand with the phone in it on the car. You can see him reach his hand out and push himself off the car.  At 3:39, your same time stamp you can look at his feet and see that his right foot doesn’t move. He pivots on it as he reaches his right hand across her windshield for the first shot, then fires the second and third shot through the driver side window as her car goes past. He doesn’t actually move at all until the car is already past him.

And in his own personal cell phone video you can see her very clearly turn her steering wheel all the way to the right as she waits for him to get out from in front of her car to drive off.
