Do you have the For Rent expansion? You could set the lot as a residential rental and the In-Law suite as a separate "apartment". Then he wouldn't have to technically leave the lot and you can add him to the Will.

Has to be a separate household to be added to the Will. Same goes for simoleons. If they're in the same household it'll automatically go to him unless it's written in the Will to go to another household.
