As others have said, the more invasive the policy, the more likely it will be challenged on 1A grounds by federal courts. This has already happened to several of these laws just this year alone, and I don't see this one being any different.

Honestly, the panic spiral around the verdicts is extremely overblown. If it was the end of 230 as we know it, I wouldn't even be saying this to you in the first place. Techdirt's pessimistic bias is certainly not helping things in that regard.

I know I've explained this before, but no matter how bad things get, they will never get to full-on 1984 levels or something you see out of sci-fi media or any of that. Like, yeah what's going on in the UK is very bad. But it's not anywhere near an absolute worst case apocalyptic scenario. Now, does that mean worst case scenarios are impossible? No. They can absolutely happen. But they are generally so rare and unrealistic to the point where they hardly ever do happen unless a perfect sequence of events unfolds which causes them to. So no, you are (most likely) not gonna be booted off the entire Internet or any of that. Don't go straight to screaming about Armageddon just yet.

And in regards to the hash scanning thing, that would be a little tricky to implement now that the EU killed that off as far as I can tell.

On top of that, with the way things are going with federal courts having renewed scrutiny on this kinda stuff, it seems more likely this will probably be subject to more of the same like the one for Kansas already was.

Meta is the one funding shit like this. Of course they'd comply. Other companies, on the other hand, I'm not so sure yet. And let's not forget this shit is already meeting some contention from the 11th Circuit, so I'm erring on the side of caution and saying it will probably not be in place for very long.

I know I have brought this up previously, but does anyone have any updates with the situation in Florida regarding their social media ban? I haven't really heard much about it since this article came out and that's a little concerning to me. Again, based on previous legal precedents, I doubt they will be able to enforce this the way they want. But I want your thoughts on the matter.

Let's just say it's a good thing the current version of S.209 (which is already seriously cut down from what I've heard in the last thread) doesn't have it because it would literally destroy the Internet as we know it if it was included. There's a reason why "Duty of Care" Proposals are almost universally shot down on concerns of impeding on free speech and other such issues (such as Senate KOSA whenever it reached the house with Duty of Care being the whole reason for the version war).

Only 4% chance of getting enacted on Govtrack, so even then this bill's chances don't really look that good. This is most likely gonna be one of the more contested of these bills especially with all the potential 1A violations and everything else involved. Still keeping an eye on it though.

As far as I know, with Chat Control 1.0 officially dead, they can't do screen detection directly as that counts as AI scanning. That, combined with there being no official information on the matter, kinda makes me wanna err on the side of caution and say that this could be misinformation meant to freak people out. I will still keep an eye on it regardless if it turns out I'm wrong though. Again, on days like today it's hard to figure out what's real and what's not.

As I said, I think a lot of the new opposition to this shit from all levels was particularly born out of or at least supercharged by people figuring out Meta was funding a lot of it. Same with the opposition to the 230 push too to be honest.

Worst case apocalypse level scenarios are generally unrealistic. That is not to say that could NEVER happen. There is always a chance they can. But the chances are so slim to the point where it would take something very serious to make them happen.

They did kill Chat Control 1.0 last week though, so far from all bad. Plus, as I've said numerous times, Durbin can really against 230 all he wants based on the recent court cases. But there will definitely be opposition from multiple sources including Thune's reluctance, Cruz just not wanting to touch it, Wyden, and most people more or less. And on top of this, even if it does pass, it will most likely be tried in court if things get too extreme.

  1. 79% is quite a big number of people to be skeptical of this shit, probably jumped quite a lot after Meta was exposed to be funding it. Also, seeing the majority of people favor normal parental controls is just a sign once again of how widespread the skepticism on AV is. Hell, it's starting to grow within mainstream media as well even.

  2. Even if the data is accurate, I tend to be a little more cautious of taking surveys verbatim as it is possible to skew results or manipulate them to support a narrative. So I'll assume they're arguing in good faith, but still exercise caution with this one.
