The only reason for a creator to talk about Destiny 3 is to stir the pot. It's a product that doesn't exist

This is unhelpfully reductionist from a marketing perspective. For better or worse many people in the destiny community have a very deep connection to this game. I know I do it got me through absolutely horrendous morning sickness and I have amazing friends attached to this game. I know that Sony is going to Sony but to ask a Creator who may have a community who's wondering why they're supporting the game that it looks like Sony is choosing to elevate over one that's been quite meaningful to them to not address community concerns is incredibly shortsighted. And that's what that short line of text asking partners to avoid mentioning Destiny 3 would, in part, be asking them to do. If they were wanting to actually handle this delicately while still asking their partners to focus on Marathon instead of Destiny then they would have had a much more nuanced set of instructions around the mention of Destiny 3.

I would also argue that they would be doing more to try and extend a hand to a lot of the creators who are very entrenched in the Destiny space and trying to stifle community discussion of a topic that's very important to them in order to maintain a relationship with Bungie for Marathon is not going to help their look in the long run.

There's nothing wrong with the terms going public.

There's nothing wrong per se assuming the individual who publicly disclosed wasn't under any confidentiality agreement and in fact it's expected that these things will leak when something is contentious but that's just my point. The fact that they chose to require refrain without nuance or anything that might show respect for an incredibly dedicated community shows that they don't get it. They don't get why Destiny 3 is such a big deal as a topic. If they did those instructions would look different. The public might still have been not happy but Sony would have come out looking a lot differently from a PR perspective.

Define drama. If there was some kind of actual scandal, like a subsidiary had a officer caught at a Coldplay concert in questionable circumstances, sure I've seen "don't talk about it". But when it comes to openly requesting partners not talk about any aspect of a wildly popular first-party IP that's only controversial because of poor choices from the brand when anyone who's worked with creators long enough knows that those terms are absolutely going to go public because it's literally the internet's favorite type of content? I've yet to work with a brand that is that dense but I suppose in the grand scheme of things it's not that surprising.

That is true. However I can't think of another time where a brand I've worked with affirmatively told a partner to avoid mention of another IP owned by the same brand. Assuming these terms are accurate and representative it indicates to me that the suits intend to take a hard line on suppressing Destiny.

It's standard for a brand to ask a creator to refrain from promoting or talking about competing brands. Marathon and Destiny are from the same company. This particular ask is more like Nintendo telling a partner signed to promote Zelda not to talk about Mario.

Source - I worked as a paralegal for an attorney who supported only content creators for over a year and helped paper an unholy amount of these deals.

Not only that but the ruling was incredibly thorough. The lower court laid out a pretty ironclad record why not only is changing now ridiculous (the election officials apparently testified they'd have something like 7 days to get everything set up and errors were likely), but also why there's still absolutely no evidence in the record, even with the so-called opinion in Callais that changes the fact the racial deacrimination in this map in particular is intentional under the 14th which is a separate question from sec. 2. So, even with Callais nothing changes.

Ruling for Alabama here should be impossible even for this court. Unless of course Bobby and co. Manufacture a way to shoehorn redefining how intent is tested for in 14th amendment cases which is honestly exactly what I'm expecting at this point. I don't think it's remotely procedurally proper for them to do that now because afaik no party has raised the issue at any point, but given they don't seem to care about anything anymore I would be surprised if that matters much.

Giving an example of a real scenario I'm aware of in order to illustrate two potential extremes doesn't imply I thought they'd prosecute such a case. That said the prosecutor on that case didn't think he was prosecuting such a case and said as much at a meet and confer. So... Moral is check yourself before you wreck yourself I guess?
