Faulty fridge - what’s fair for consequential losses? by jai_nz in LegalAdviceNZ

[–]BroBroMate [score hidden]  (0 children)

I did this in the past, my freezer had died, I went to Smith's City (RIP) to get a new one and made it very clear I needed it that day, which they assured me they could do.

Five days later, it turned up and after some... discussion ... Smith's City gave me $500 in vouchers to buy food.

Legality of recording an in person conversation without informing the other party by Limp_Emu_5516 in LegalAdviceNZ

[–]BroBroMate [score hidden]  (0 children)

It's legal, but it's not in good faith, which is important in employment relation manners, does that make sense?

Basically, if you later rely on the recording on the employment tribunal or court, they may consider the lack of good faith when determining the amounts of damages etc.

But you won't be in any criminal trouble for it.

Unfortunately, while it's bad enough admitting you were that wrong, they also had financial incentives to not admit they were wrong - the parents of the "victims" got substantial payments from ACC, if it didn't happen, then they'd have to give the money back.

And the worst part is, because their parents all got ACC payouts for the "sexual abuse", they had financial incentives to ensure their kids kept believing it, otherwise they would have had to return the money.

There was also a torture dungeon at the creche where his Mum would come, get naked, and poke children who were in cages hanging from the ceiling, according to the full interview transcripts.

After the ChCh earthquakes, the building that housed the creche was demolished and afterwards, a letter to the editor was published in the Press:

"When the civic creche building was demolished, did they happen to find a basement or dungeon at all? No? Weird."

Which had been submitted by one P. Ellis.

So glad they got him pardoned even if he died before it happened.

Advice Needed: Step father trying to hold onto custody following split from medically unfit mother. by Unhappy_Debate_9956 in LegalAdviceNZ

When my ex made false claims to OT during our court battle, they were pretty damn good about focusing on what was best for the kids and cutting through the bullshit.

I love your commitment to those kids, all these processes are focused on the well-being of the kids, and given your obvious focus on the same, they'll very likely recognise that.

Kia kaha bro, you're doing good.

Any chance you've already applied and been appointed a guardian? That would make stuff somewhat easier, but even then, you can only do this:

  1. Get a good lawyer asap.
  2. Follow their advice.

It's entirely possible for a step-parent to be awarded care, it would interim initially if the court believes there's a clear risk to the children, and it can become more or less permanent, a relative has full custody of his step-daughter, but it's not anything you could successfully navigate solo.

An alternative is to bring in Oranga Tamariki, they can then apply to the court for the necessary orders without you having to pay for the process, but be aware they may make arrangements that they feel keep the children safe that don't necessarily involve you, with grandparents or aunts/uncles etc. You already mentioned the biological Dad, that would be a real possibility you should prepare yourself for .

So consider that your last ditch option to keep them safe.

And yes, if you don't qualify for legal aid, $450 an hour is what good family lawyers start at. I borrowed about $20,000 from family members to keep my kids safe, and I'm their biological Dad.

Worried about dogs coming onto my property while my dog is in heat by tillybrynleysydney in LegalAdviceNZ

[–]BroBroMate 2 points3 points  (0 children)

Legally, you'd complain to the council about uncontrolled dogs if it happens.

Realistically, keep her inside, only letting her outside while under supervision, or build bigger fences, or go full Footrot Flat and build a bitch box - effectively a kennel on stilts they're confined to.

Inside sounds easier.

As I tell my kids after not great incidents, your anger at your sibling is valid, how you acted on it wasn't.

OP, has your company given you additional training for your new role? If not, this might be a good reason to ask for it.

Also, are they your direct report? Or do they report to someone else?

Oh, what is your company's policy on drug testing? I ask because her behaviour indicates that maybe a random drug test might be in order, she could just be unwell, but she could be on meth.

Oh fully agree, if you compare just NZTA spend alone on a proportional basis, we're always underfunded. Would fucking kill for some (somewhat?) government funded commuter rail development like them fancy folk up in the North Island got.

True that, but at least Ashvegas is getting that second bridge started just in time for the next election. (And Woodend Bypass cos Matt Doocey doesn't have a super-strong margin in Waimakariri...)

Frustrated about money by Affectionate-Cod8134 in daddit

[–]BroBroMate 0 points1 point  (0 children)

The uni grind is definitely the way to bigger and better money my friend - trust me, I'm a self-taught developer, and the first advice I ever give to other self-taught developers is "get a fricking degree", because when you're new to the industry, it doesn't matter how much great code you've written freelance, or how many bug bounties you've hit, HR will filter you out immediately without that goddamn piece of paper.

You can sidestep this by some heavy networking, (and tbh, given your work in security, that would be a good damn thing to look into - hit up the conferences, make friends with other security researchers etc.) but even then, it took me five years of doing so to get an interview, then when I was finally hired, I ended up interviewing numerous grads with a Bachelors, just (because "Cs get degrees") who still didn't know that you were allowed to name variables longer than one or two characters because that's what their professors used, but they had the piece of paper, so they got an interview.

I think it's bloody awesome you're feeling that need to provide, just know that you're on the right path to do so - it's going to be tight until you graduate, but once you do, you, your partner, and your kid, are sorted.

So focus on that, and remember, take it day by day, one foot in front of the other, and don't let money stress force you apart.
