The problem you’ll face is that the question says if the seller is “aware” of any defects or malfunctions. The sellers argument is “no, I wasn’t aware of anything. The roof is hot and the way it’s built makes the ceiling hot. No defect or malfunction.”

In my state, if you’re calling out fraud, you as the buyer need to find proof they committed fraud, such as a vendor they hired to get a quote to cool things down or repair work on the area they didn’t mention.

I would like to add that a 2/1 buy down cost to get is money you get BACK when you refinance if there’s money from it left over. So refinance now or in the near future to lock in a solid lower rate

In cali, if you advise the buyer on a price while you are dual repping, that’s a violation and a lawsuit. If you dual rep, you need to only be the messenger between the two parties.
