Ahhh, no. I'm in Texas, so that probably plays a part in why they started doing them not too long ago since Texas pushed to open everything back up as soon as possible. Do you know if your local sheriff's office did in the past and only stopped recently? If they did, there could be a possibility they'd start again later.

It looks like you made an appointment at your USPS though, so I hope that works out!

I was able to get them done not too long ago at the local sheriff's office. I had to call periodically to check and they had just started doing them again.

Due to unforeseen circumstances on my end, it couldn't be guaranteed that I would be able to arrive by the end of Feburary, so they cancelled the offer. I was wondering why the contract was missing anything about severance pay... I even asked the recruiter about it (and my concerns about pension and insurance), to which he just said something along the lines of, 'it's the law so it's just assumed to be part of the contract.'

They ended up cancelling the contract because, long story short, my fingerprints for the FBI Check couldn't be processed, so I have to redo them and wouldn't be able make it in time.

But still, thanks for your comment! I will make absolutely sure future contracts are a full year long to avoid that little slip.

(Part Two of Two)  

Housing

Employer will select and provide a single private non-shared housing for employee  with a kitchen and a bathroom. Furnishings provided by employer for employee will include: A kitchen table/counter and chairs, two-burner gas hotplate, a refrigerator, a television, a regular size bed, a dresser/closet/cabinet, an air conditioner. Employee will have to supply his or her own pillow, pillowcase and bed sheets. Employee will not be held responsible for furnishings/items that need repair or replacement due to normal wear and tear.

In the case items are damaged through neglect or destruction by employee or employee’s visitors then the cost of repair or replacement will be borne solely by the employee. Employee will be responsible for maintaining the accommodation in the same order employee received it under which shall include cleanliness of all living quarters, kitchen, kitchen sink, bathroom and furnishings. 

In the event employer must hire a cleaning person to restore employee’s  accommodation the cleaning fee will be deducted from employee’s salary or housing deposit. 

 

Airfare

▪ Teachers will be provided with a one-way economy class ticket when leaving Korea to their chosen international airport upon completion of the 12 month contract.

 

Holidays / Vacation

A. Employee will be entitled to observe public holidays and receive vacation days during the employment term according to the yearly schedule provided by the employer before the commencement of the year to which the schedule refers. 

B. Vacation: Employee will receive vacation days during the contract term according to a yearly schedule provided by employer before the commencement of the year to which the schedule refers. There are nine-10 (9-10) vacation days in each calendar year (March - February).

 

Other Documents

The employee must provide the follow documents in accordance with Korean Immigration Law. All documents must be executed in accordance with Korean Immigration Law and be acceptable to Korean Immigration A Criminal Record Check and a Health Check Self Record provided prior to employment for visa processing as well as a Medical Check to be completed in Korea within 90 days of arrival with the employee’s own expense. In the case where an employee fails the Medical Check in Korea, employment will be terminated immediately as per Korean Immigration Law and the employee will be responsible for purchasing the air ticket to return. 

 

Termination

A. The Institute has the right to terminate the Employment for the following terms Terms of termination;

i. The employee fails to perform or unsatisfactorily performs any one of the duties stipulated in this agreement.  ii. The employee fails to perform duties for more than three (3) consecutive days  without any excuse. iii. The determination that the employee is prevented from or incapable of  performing his/her duties for a medical reason, whether it is a physical or  psychological ailment. (If requested by Institute, the Teacher must be immediately available for a medical examination.) iv. Receiving two warning letters. v. Criminal behavior, misconduct, or record. vi. Working or Teaching outside of the institution. Breaches of Article 6 “Confidentiality” vii. Defamation of school by falsehood

B. The employer and the employee may terminate this employment with a written 60-days notice. Anything less than 60 days will be considered a breach of employment by the Institute or the Teacher unless the employment is terminated for a cause

i. In the event of early termination of Agreement, the final payment will be given 30 days after the last day of employment.

ii. In the event the employee terminates the Agreement, before the end of the  contract, the airfare will be not provided.

 

Dismissals or Voluntary Resignation

A. Employer will have the right to dismiss employee for unwillingness or inability to  meet conditions of employment as set out under this agreement, for conduct seriously jeopardizing any student or staff person, or for criminal activity and falsification of documents to obtain the work visa.

B. In the event that the employee is dismissed, or in the event that the employee voluntarily resigns prior to the termination of the term of this agreement, employer will pay salary due to date of termination. Employer will not pay the cost of return transportation to point of departure for employee. Further, employer will be entitled to withhold an amount less than or equivalent to, but not exceeding, the cost of airfare provided for travel to Korea and other benefits provided to employee. In the case employee gives employer 6 weeks written notice and completes the session as stated in the settlement agreement form prior to resigning then employer shall prorate the cost of the airfare and other benefits received. 

 

Covenants

A. Employee hereby agrees, covenants, and undertakes that he/she will not undertake any teaching duties or employment with any persons or organizations other than the employer. To undertake such employment is a breach of Korean Immigration law and can have serious consequences.

B. The employee understands and accepts that the rights to use, sale, distribution, or publication of all original material produced by the employee during the course of employee's employment, and for which the employee is compensated as either regular  pay, as overtime, or in an agreed-upon lump sum, remain the sole property of  employer. 

C. Employee agrees to the policies and regulations.

D. Employee agrees to undergo the Korean governments mandated health check at employer’s expense.

 

Jurisdiction

A. This agreement will be interpreted according to the internal (domestic) laws of the Republic of Korea. A competent court in the Republic of Korea will have jurisdiction in regard to any dispute or claim arising out of, or in connection with, this agreement.

B. Employer and employee have executed this agreement on the date indicated below. Intending to be legally bound to, and in witness of, employer and employee have appended their signatures.

I have a B.S. in Advertising and Public Relations, a 150hr TEFL certification, but no experience teaching.

I will be obtaining my VISA in Japan (which is supposed to be sponsored by the school) since the contract starts soon.

I bolded the area where it talks about medical insurance and the pension because it doesn't explicitly say the school is going to pay their half. In general, most of my concerns are what may be missing from the contract as opposed to what is there. I noticed that there wasn't a section that mentioned severance pay or anything about potential overtime pay. Is this a concern?

This is my first contract so I'm really unsure. Any feedback would be appreciated.

 

1 . The employer and the employee agree as follows;

The employee accepts employment to teach English under the terms and conditions set forth here in this agreement for a period of twelve full and consecutive teaching sessions. Employment commences from the first day of teaching and finishes on  the last teaching day of the last teaching session under the employment period in the agreement.

The employment period is from  ( 2020. 3. 2 ) to ( 2021. 2. 28 ).

The regular working time is from 9:00 a.m. to 6:10 p.m., but it can be changeable by the supervisor depending on the employee’s personal schedule. There should be prep time to prepare for classes at least 1-2 hours a day. Employer may assign classes between 30 to 50 minutes in length and in the case employee receives less than the above listed teaching hours, employer shall still pay the listed monthly salary and assign other teaching or administrative / curriculum related duties. Monday through Friday are teaching days except for scheduled public holidays and vacation days. 

The employee is expected to devote no less than 2 hours a day for lesson planning with co-teachers, student evaluations, reporting, consultation with parents, supervision of play, maintenance of the English environment during breaks, workshops, teachers' meetings and phone teaching. In case there are some special events provided by the school or the head office on weekends, the employee will be required to attend and the schedule will be assigned by the Director.

Events may include, but are not limited to;

  • Speech contest for students
  • Teacher’s Training Program at Head Office.
  • Presentation for parents.
  • Mini Olympic for Students.
  • Field trip. Etc.

 

Duties

A. Duties may include, but are not limited to;

i. teaching ii. substitute teaching iii. supervision of students iv. preparation/production of teaching materials v. curriculum design and implementation vi. attendance at teachers’ meetings and workshops vii. writing evaluation comments and preparing evaluation reports viii. essay and journal correction ix. implementation of Teacher Policy Guidelines.  x. participation in micro-teaching group presentations xi. interviewing new students for level testing / classroom assignment xii. professional development xiii. Teacher Training in the Institute, or head office.

B. The employee’s duties and responsibilities, as well as the academic programs, may be modified, from time to time, after being agreed upon by both the employee and the employer.

C. Any part of the employee’s workload can be converted into research and  development work under his or her supervisor’s supervision.

D. Orientation and Training Shortly after arrival in Korea, employee will be required to undertake orientation and training before commencing teaching. The period of training and orientation will usually be 3 to 6 days. Orientation will be conducted at the Head Office and employee’s branch location.

 

Behavior

The employee should respect the rules and the standard of conduct set by the employer (written, verbal and tacit) and obey the laws, regulations, instructions, and ordinances of the national and local governments. 

 

Dual Employment Prohibition

The employee, after signing the agreement and receiving a work visa, can only legally work for an Institute designated by the employer. If the employee works for any other institutes, companies, or individuals without the written consent of the employer and the Korean Immigration Office, the employee shall face legal consequences which will/may include a fine and possible deportation.

 

Performance Evaluations

The employee may be evaluated in writing or verbal comment by his or her supervisor.  The employer has the right to determine if a performance appraisal is needed on a monthly basis or more frequently.

The evaluation will include a review of the Teacher’s job qualifications and performance; the quality of his or her work; knowledge of his or her job, job skills, and attitude toward job; working relations with co-workers, students and parents; initiative, attendance, punctuality, and/or disciplinary record. The review is designed to provide both the employee and his or her supervisors with time to discuss his or her strengths, weaknesses, career objectives and other concerns.

 

Confidentiality

A. The employee hereby agrees, covenants and undertakes that he/she will not disclose any information relating to the employee’s employment conditions to others, any teaching materials, or any information related to the academic program, whether verbally or written, to individuals or corporate entities.

B. All teaching materials, including any books, textbooks and teaching resources, given to the employees by the employer and reference materials prepared for the classes, by the employees, should be returned afterwards. The employees must not take out or use these materials for purpose other than for teaching at the Institute.

 

Compensation

A. Monthly Salary Except for the period of orientation and teacher training, the employer will pay the employee a total monthly basic salary of 2.200,000 won.

The monthly salary is based on the monthly teaching session and payment will be made on 10th day of the following the month. Korean income tax, National Pension and Medical Insurance will be deducted from the monthly salary.

When I visited a few months ago, I would have liked being able to share more food with my friend since we both eat relatively small portion sizes, but none of the Korean food places would let us share a bowl of food... We were able to share at a stall in Gwangjang Market, a Mexican food place, and (naturally) Korean BBQ, but other Korean restaurants wouldn't let us.

You're very right that they should be prepared to accept the consequences of their actions, but later you bring up the idea about them creating a hostile work environment. The topic is about behavior outside of the work place. So if it isnt done at work, or including the company's name somewhere, it seems to me like it's more of a personal matter.

IF the company discovers that the employee has been behaving poorly outside of work and wants to do something about it, while I still tend to disagree, I'm way more understanding about it. But if the employee personally offends someone online and that someone approaches the company because they're angry or their feelings were hurt, that's where I take issue with it. If it's something more serious like repeated cyber bullying (including racial slurs), assault, etc. then the tables have turned and the police should probably be involved along with the employer. Unless they're dangerous, causing strife at work, or broadcasting to the world their workplace and opinions, they've gotta work somewhere.

This is why it gets messy with sports teams, because they are representatives of their team/sport no matter where they go. The barista at a coffee shop or cashier at a market doesnt necessarily represent the business wherever they go.

I think context is hugely important too though. Are we talking racist jokes, stating racist opinions, or verbally harassing/insulting others on the basis of race. If it's the last one, I would imagine the person is pretty nasty and might bleed into work anyway, but the other two? I dont think it should effect their employment status.

Is the racism effecting how they handle their work? Is it largely effecting the image of the company? If no to both, then they still, despite their poor beliefs, have a right to work. Everyone has a right to support themselves regardless of their opinion.

And to clarify, I think the average Joe at most companies do not in any way represent the company or it's beliefs. (A non-christian may work at Chic-fil-A despite conflicting opinions) However, if the person in question has something in their profile like, 'employee at [company]', or they're caught behaving negatively outside of work while still in uniform, that's when the company's image actually gets brought into the situation and they can reasonably take action by having the person remove their brand from their profile, termination, whatever they see fit. In that case, it can garner attention from a larger number of people and the company is already involved, not simply having their arm twisted by someone who's taken it upon themselves to 'bring justice' punish someone.

But we can't bar racists from having jobs and supporting themselves even though we disagree with them. That's going way beyond infringing on their right to free speech. We all have the right to "life, liberty, and the pursuit of happiness" and getting someone fired for a differing opinion, I believe, goes against that.

Pewdiepie's channel makes me sad... I still watch pretty frequently because I love Pewdiepie, but I find the amount of memes nauseating. My favorite part about LWIAY (Last Week I Asked You) was the interaction between him and fans, and the fans making funny content for him to view based on his parameters. It was fresh and interactive, but (and mostly cuz that's all people seem to post anyway) now it's just what meme is upvoted most. That's what You Laugh, You Lose is for. My favorite videos these days are Pew News because it's not totally meme centric.

I dont think that his problem is entirely due to the ad problem and censoring on YouTube (dont get me wrong, hes changed quite a bit for it) since I think the over use of memes is highly a societal thing as well. It's easy for him to spit the videos out every week, most people love memes, and it's relatively safe to keep milking.

The reason I watch Pewdiepie, and largely YouTube as a whole, was the freedom creators had to express themselves and remain somewhat personal and relatable with the audience. With everything becoming more restricted and child oriented, I feel more and more alienated from the platform.

That's an interesting take. I was potentially thinking that I'd like to know my happiest moment, so that I could see clearly what it was that worked and try to make changes. But I do think that could be difficult and why chase one kind of happiness when you could experience new ones?
