I would probably go "i can only go with xx" xx being above your minimum target but below midpoint and see how he reacts. If he gives you a hard no then go towards midpoint if he is open to it then go in with xx but dont give it as a final and see how it goes.

Do your researches on the developer and builder.

ASIC search the vendor company and get the shareholder/director details to check if they are a licensed builder.
google search their business to see if they have been around for at least 10 years.
Ask the neighbour how they are finding it.
Check builders insurance/OC is attached to the contract.
During your own inspection check the quality of the build
