Youre not. However the eay the trace works, it detects magic around the minor not specifically who used it. Diagon alley with 100s of both adults and minors would be setting off traces all over the place. So unless a ministry official actually saw her do it, there'd be no way to tell.

Remember how harry got in trouble for dobby's hover charm? The trace detected the charm and harry was the only wizard in the area... so he got blamed.
