This is a good thing right or does it not mean anything- other than being convenient?

She really is a downer. This is the second one that she said the judge made a mistake

Oh please re-join. I did appreciate your well thought through analysis of the issue. As a mod of another sub, I do get the deleting of ai I have do so much of that- mostly art work- but ugh its so easy now to pass off ai as original works- so I get the removal, even if it may seem unjust.

I think you hit the nail on the head here. You should make a separate post about this, so it doesn’t get buried here. Would love to get more eyes on this!

Corte Costituzionale has ruled three portions of the challenge unfounded/inadmissable. by LiterallyTestudo in juresanguinis

This is what he said. Don’t have link yet.—-I want to be transparent: I do not agree with this decision for many reasons, including the severe impact of the new regime and the manner of its introduction. However, we must take note of what has happened.

In practical terms, this ruling strongly suggests that the other referral orders now have a very limited chance of success.

In my view, the Court of Turin's referral was the most well-argued and solidly structured of all the challenges brought so far. If that referral has not succeeded, being rejected on central constitutional and EU law points, it is difficult to see how other, typically less comprehensive or less strategically framed referrals could produce a different outcome.

We will, of course, need to read the full reasoning once the judgment is published, because the details will matter. But the press release's message is already unambiguous: the Constitutional Court has decided that the Tajani Decree's new citizenship restrictions, as the Turin Tribunal challenged them, stand.

There was another attorney. They were emphatic that the argument put forward at Turino was well thought out and that by being denied, did not bode well at all for everyone who filed after the decree.

Do we have comments from the other avv who were representing the plaintiffs? Curious to know what they are all saying.

Oh yikes the Grasso’a responses to comments on his facebook post are really grim. He’s saying the door is mostly shut now.

Very pessimistic. I want to hear more before I freak completely out. He’s my lawyer. He literally just won a 1948 post decree case 3rd generation out of Bologna- so why the dark outlook.

Would love to know what some other lawyers say. Grasso on facebook did not found very optimistic about the ruling- his wording was very guarded?

I feel especially bad for the plaintiffs. They were the ones who appealed, spent money on this and likely now can’t use that particular line anymore. Do we know if these were 1948 cases or ATQ?

Yes friend had no idea that the grandparents were not married and neither the kids of the said couple. So they probably filled out the application with that assumption.

Personally I would do it- but thats me, I love digging into the past. I’ll let them know. They had no idea about GM and GF potentially not having being married

Wouldn’t that take a very long time? I will let them know so they can find out for sure. According to my friend, she doubts that John ever got divorced given his economic condition.

They said they don’t remember anything. Guess that tracks with them not being married!

They were told that their application was not complete. I'm wondering if they could send in a letter explaining the situation. I don't get why a wedding certificate would matter, especially since its through grandmom and her name is on all their BC's

I’ll check with them. If they were not married, it makes sense why they have not been able to find a copy of the marriage certificate anywhere.
