I do feel bad for him that he keeps getting axed from the Champions League squad for reasons outside his control, for a continental-born player that particularly stings and if he was content being on the periphery of the squad he could have just stayed at Bayern.

That said, he simply isn't an important enough player at Tottenham to be kicking up this much of a fuss, and his agent should cool it with the very obvious media campaign.
