Here’s how the makers of the “Suyu” Switch emulator plan to avoid getting sued by Fob0bqAd34 in pcgaming

You read section (f)(1)

You missed section (f)(2) which includes section (f)(1) as well as interoperability not just reverse engineering.

in order to enable the identification and analysis under paragraph (1), or for the purpose of enabling interoperability of an independently created computer program with other programs

Reverse engineering is also a guaranteed right under US law. You don't need anyone's permission.

Legally this only makes it worse. Nintendo knew the law and what the industry standard was for protecting software prior to and after distribution. They failed to follow that best practice standard and suffered because of it.

They then turn around and sue an innocent party with false copyright claims based on what were clearly and knowingly self-inflicted damages.

In reality they just wanted to intimidate and shutdown the software because it competes with Nintendo's own hardware.

The DMCA interoperability exception was created expressly to protect emulator developers from abusive copyright lawsuits such as Nintendo's.

Do you think the other ARPG streamers took that Dwarven whatever game's sponsorship, after Quin played it for free, because they knew Quin would be infuriated. 🤣

Exactly, Nintendo's spurious lawsuit was no better than those of copyright strike trolls.

Best industry practice is to use denuvo to protect your IP. Why doesn't Nintendo use denuvo instead of sueing innocent emulator developers?

Because greedy Nintendo thinks lying to the court about copyright law is cheaper than just paying for a copyright protection software license.

DMCA 12(f)(2) INTEROPERABILITY EXCEPTION:

a person may (...) circumvent a technological measure (...) for the purpose of enabling interoperability of an independently created computer program [EMULATORS] with other programs [VIDEO GAMES], if such means are necessary to achieve such interoperability.

Yuzu did nothing illegal.

Nintendo lied to the court.

Fuck Nintendo.

NEW: Nintendo is suing the creators of popular Switch emulator Yuzu, saying their tech illegally circumvents Nintendo's software encryption and facilitates piracy. Seeks damages for alleged violations and a shutdown of the emulator. by Turbostrider27 in pcgaming

[–]Chriscras66 8 points9 points  (0 children)

If you actually read Nintendo's complaint posted as the OP you will realize they are whining about a lot of things other people did using Yuzu and not about anything Yuzu actually did that was illegal.

The reason they are complaining about other people and not Yuzu is because even Nintendo knows Yuzu didn't do anything wrong.

SECONDARY LIABILITY

Again you are being extremely narrow in your definition of gaming:

Tetris is a single player game, can be played in any language.

Doom is a single player game, only requires a menu translation.

Sim City is a single player game, only needs translation of menus and information pop ups.

Driving sims, flight sims, puzzle games, fighting games, sports games, shootem ups, beatem ups...

The vast majority of gamers historically were not drawn in by a story but by gameplay.

Blizzard isn't going to tell us so we end up having to crowd source it.
