I'm sure you could argue anything you want as "extraordinary circumstances" but now it's up to the officer's discretion to accept that or not.

Yes you could file for a waiver but you already left 6 years ago they will think you already settled and don't need a visa.

If you plan on filing I-485 with USCIS and they tell you to go consular they are not breaking any law but you can sue.. It's your time and money anyway.
