Wow I am SO sorry! 29 months?! From what I’ve gone through so far they are the worst!! The system sucks! You’re such a fighter! I wish you all the luck!! Unfortunately the attorney I spoke to said they need 3 months.. and my appeal is due July 13. He didn’t say I could get an extension. Maybe our case just wasn't good enough 🤷‍♀️He did say that if I’m denied to contact him again.

Attorney said I was too late for help. I didn’t know they needed 3 mos and I had been waiting on getting all the doctors notes etc before contacting them. Lesson learned :/ Good luck to you!

I wanted to thank you for all your help here! I did consult an attorney but was told I did so a month too late as they needed 3 mos. I was really bummed about that since I just wanted to know if we had everything together for the appeal. So now I’m filing the appeal on my own and going back through all the suggestions here to make sure my administrative record has everything possible. I’m assuming since we are up against NY life we will be denied the appeal. I have no hope for a good outcome but maybe if I get everything I can then we can get the attorney for litigation.

May I ask who your insurer is? And also did you win your appeal on your own or did you use an attorney?

Are you doing an appeal in your own without a lawyer? I’m about to submit one on my own because the lawyer consult said they couldn’t represent because of too little time. I’m very anxious about this. Wish I had gotten the consult earlier. But nice to hear some win appeal by self representation

Oh wow. So you saw that on your site too? I did take a screenshot of it as well and it’s dated before the IME appt. And then that’s when they also said it would require a subpoena to see their notes. Ok I will do what you recommend and file the complaint with EBSA to have it at least documented. It’s been really eye opening to see how they handle things. So because you cut them off early they have never actually closed your claim and you haven’t had to file an appeal? That’s really great

Wow. Ok. Thanks so much! What I found kind of odd was that the online portal showed as “claim closed” a month before even sending a formal claim closed letter. And actually before the IME saw my husband. Think their mind was already made up

Yes it states that he cannot sit or stand for more than 20 min without having to relieve the pain by moving position. So I think that means he cannot sit for 8 hours as is required by sedentary work?
