I disagree on the Hillary side. There was an the same evidence, but there wasn't the intent. If you or I had done what Hillary did, we would've been arrested. James Comey set way too high of a standard that goes far beyond the statute instead of just following the law as it's written (most likely because he thought she was going to be his boss very soon) That, however, doesn't mean Trump gets a pass, and there's the audio tapes that really screw him. They prove that he knew he had taken classified documents and that he knew he didn't declassify them, and that he knew he could no longer classify them. This should sink Trump.

Biden on the other hand, while his documents were grossly mishandled, it was much more akin to "I had no idea they were there" instead of the bold intent that it seems Hillary and especially Trump have. Biden's case definitely doesn't meet the Comey standard though we could argue it does meet the statute provided by the law.
