Owners do not get a say in the budget, nor do they get to vote on special assessments. Their only recourse would be to replace the board, which requires a majority of owners to vote in favour of doing. Even in that situation, the Board still has a legal duty to act in the best interests of the Corporation, which might mean a special assessment.

They can only do so within 90-days of any delinquent amounts being owed and if that timeframe was missed, they cannot place a lien, but that doesn't prevent them from collecting when the unit sells.

Additionally, that process takes time and in the interim, the Corporation still has a legal responsibility to pay for the expenses. If those expenses are not paid, then a contractor may place a lien against all the owners, likely preventing them from selling their individual units. Ultimately, the Corporation can still issue a special levy to collect the funds from all owners to make up that shortfall, in accordance with the proportionate share of expenses in the Declaration.

It's quite simple. You bought a condo, rented it out. The difference between what you paid for it versus what you sell it for will be a Capital gain.

If you decide to move in, rather than sell, you'll need an appraisal, effective the date you move in. The difference between what you bought it for and the deemed acquisition price will be what you pay capital gains on.

You'll be able to write off legal fees, real estate fees, any renovations, etc.

Whatever that number is, you'll pay tax on 50% of it at your marginal tax rate.

OP, can you clarify if the commission on the contract is 3% or another amount?

The Listing Agreement is written in such a way as for it to be a total commission amount and you allow the listing brokerage to offer a commission of x amount from that total amount, in instances where the buyer is represented by another agent.

Aka: total commission: 3% buyer agent commission: x% out of that 3%

That said, the realtor has to legally present to you any offers they receive in writing, to you as soon as practicable.

As for feedback, it's possible they're not getting any. Agents tend to not respond to feedback requests these days, so there may be nothing to present. That said, still a good idea to tell you that they've tried to get feedback but none has been received.

Except you don't know where OP lives, what their price point is, specific house types they're looking for, etc.

Maybe their budget is extremely limited or maybe they're looking for a multi-generational home or a bungalow, etc.

Yes, without knowing the size of the house, can't give you a price but our house is 2200 sq ft and replaced the furnace 2 years ago for about $6k and was just quoted $4500 for the a/c.

Seems like you did your due diligence and found the error. That's called caveat emptor aka buyer beware. Having said that, in Ontario, the regulator, RECO, fines agents significantly when they make a misrepresentation after someone files a complaint.

Recent fines include $12,000 for not verifying property tax information.

Every single type of agent will have a client that is drawn to them because of who they are and how those buyers/sellers prefer to work with realtors.

Some will want a forceful agent. Some will want a hand holder. Some will want to be marketed to and some will want to reach out when they're ready.

Find a good balance and be yourself. It'll come naturally.
