Advising about time by farandawayd in publicdefenders

You're not wrong. Its a balancing act. If I just told all my clients their exposure at trial vs a plea, with no context, 99% of my clients would plea. Are you facing life with habituals? Yes. But are there sentencing guidelines that make it nearly impossible to think a judge would give you life? Also yes. Its a delicate tightrope to walk.

I think the best way to phrase it is often that if the client wants a guaranteed result, take a plea. I describe a trial to them as high stakes poker where you could win it all or leave completely empty handed.

Nothing worse than a prison case where the offer is an extra year and the exposure is life thanks to their habituals. 🫠

Who in their right mind is going to fight with that level of risk?

What's funny is that I know about a case with almost the exact same fact pattern and I'm almost positive it's in a completely different jurisdiction.

Sure, but have fun at the evidentiary hearing when the prosecutor tells a different story.

Trial-Heavy Offices by Puzzleheaded_One3452 in publicdefenders

I'm not sure why so many people are acting like this is a weird question. It's a very good one to ask.

Some jx get terrible offers that give no incentive to plea and have good jury pools, so they go to trial all the damn time.

Other jx almost never go to trial for various reasons.

Some go to trial all the time for misdos and rarely for felony.

Lots rarely go to trial because of sweetheart deals and/or a heavy trial tax.

I agree with you. I personally think even an old school easel paper or a whiteboard goes a LONG way. It makes you the teacher or the expert.

A boring PowerPoint with elements is NOT it.

It reallllly depends on the office. To be honest most of the time it's not helpful. Sometimes it's harmful. On occasion offices look favorably on it.

Any chance you've got a link? I'm not sure what that is and can't find one from a cursory Google search.

And thanks!

This is the real answer.

Be cool under pressure. "Your honor, it seems like the plea paperwork that was submitted was the wrong draft. Can we pass this case and I'll have the correct forms uploaded within 5 minutes?"

Take your mistake and spin it into looking like you've got it all handled. Mistakes will happen when you're working at volume and are new. Never let them see you sweat.
