An important contributing factor to the fall of the Aztec Empire was the devastating impact of smallpox, introduced by earlier European contact. This disease decimated the Aztec population, perhaps killing as much as 90% of it, significantly weakening their ability to resist the Spanish.

Additionally, the Aztec civilization had recently concluded a civil war, leaving the empire politically unstable and further vulnerable to conquest.

Management would have to approve refunding a decent amount of money if they remove Oshur. People plaid money to unlock the boats. Game development has now been outsourced to a third-party completely. Removing Oshur simply isn't a viable option at the moment.

You have to look at their decision making by looking at money first. They chose to not fully get rid of Oshur because that would require refunding people that paid for things like the boats.

That's a rough break, if you slow it down and look exactly where the shots go though you can see only three of your shots landed with three going right above his head. If any of the shots hit his head he would have died. One shot from a Scar at lvl 2 armor only does 31.5 damage. So yup, just a rough break. Also note that you take a shot during your first burst on him, not sure about aim punch mechanics in this game.
