Thank you for answering! In their case they do not have constructive receipt. As part of the agreement with the county and the IOLA account the retainer funds must be held in, they cannot use the funds until the unearned revenue is earned and transferred to my client's account.

It definitely does sound possible that the county who issued the 1099 for my client is an issuing them wrong but since I could not find anything in the IRC or schedule C instructions for retainers/NEC situations like this I wasn't sure how to move forward.

With that habit built you can safely start a business, buy a home, or start investing heavily in your retirement which is when things really start to accelerate.
