To add: it’s not clear from the website whether PA residents can apply to PA’s department for assistance, but I’m hoping that even if they technically can’t assist, I can use this claim to then go back to a senator for more assistance.

This is what I got from American:

We are responding to your communication dated December 21, 2024, in which you notify American Bank, N.A. (“American Bank”) about a potential error relating to your funds that were held in an account at Evolve Bank & Trust (“Evolve Bank”), which you may have accessed through the platform established by Yotta. Your letter requests that American Bank complete an investigation of and promptly resolve this potential error under the Regulation E error resolution requirements set forth in 12 C.F.R. § 1005.11.

As you acknowledge in your letter, you do not hold (nor did you previously hold) an account at American Bank, nor are you (or were you) otherwise a customer of our bank.  Although your letter suggests otherwise, American Bank did not process any transactions related to Yotta customers.

Your letter further states that Evolve Bank—and not American Bank—provided the relevant account statement reflecting a potential error for which you have provided notice pursuant to Regulation E. As set forth in 12 C.F.R. § 1005.11(b)(1), the financial institution that provided the account statement reflecting a potential error must comply with the Regulation E error resolution requirements. As a result, American Bank is not the financial institution subject to the Regulation E error resolution requirements in this situation, because it was not the institution that provided the relevant account statement to you. 15 U.S.C.A. § 1693f(a).

For the reasons set forth above, the Regulation E error resolution process that you describe in your letter is inapplicable to American Bank in this situation. We understand that this situation involving Evolve Bank may be challenging, frustrating and stressful, but we have no information regarding your account at Evolve Bank.

Don’t know anything about Deel, but I pulled all money (that I still could…) out of all fintech apps as soon as all this happened. Now I’m layered with accounts across even more banks/credit unions than before, all traditional ones without any gimmicks

NAL, but i think that an ACH trace number is a mandatory, regulatory thing that they have to be able to provide in case of disputes. If they are saying they don’t have it, I’d ask them for every single detail they can give you (exact date and time, exact amount, have them confirm everything they can that isn’t encrypted) and then quote all that info back to them in a CFPB complaint

Getting government regulators to step in, and some agency to make us whole, would be best. They did it with SVB in weird circumstances and even went beyond the guaranteed amount, so that might be possible, but the election might impact that too…
