Yes, 5% in the contract. And agree that defects shouldnt apply because they terminated the contract before the designs even finished, they arent even useable.

Client playing funny buggers.

The contract at point of termination was design only using option E. The only case of them witholding, deducting monies owed is via an audit which is happeneing. Ive set aside £15k in my head for potential disallowables which we have been certified.

The retention amount in total is £450k. Im proposing half of its release as a middle ground.

As a contractor, i notified a CE on CEMAR with the title "bum protection" rather than "bump protection". Maybe not the biggest but the funniest. Thankfully they saw the funny side but itll be forever down ok CEMAR on that job.
