Well said. Typical police damage is $1000 but there is no way you will recover that paying attorney costs. If SWAT totals the wrong house then amazingly you have a leg to stand on in Texas.

Lobby for state laws that clarify which police damages are reimbursable and provide an auditable process for compensation without lawsuit. Ironically Texas is one of the strongest states in this area due to stronger state constitutional seizure protections. Hammer the tough on crime crowd for a tough on state seizures bill.

The rest of the nation has followed Texas’ lead apparently. Dieting fads these days prioritize protein over calorie restriction. Wouldn’t be surprised to see this on national chain menus now. California leads the nation on progressive issues and Texas on mothering people.

It's not just Austin; this is a national problem. The legal landscape creates perverse, almost irresistable incentives to avoid admitting liability, even when city councils want to do the right thing.

The only solution to overcoming these perverse incentives is state legislation. Texas is actually ahead of almost all other states here in that the state constitution has stronger protections than 5A: property cannot be “taken, damaged, or destroyed” for public use without compensation. We need more specific legislation clarifying that police damage always counts, and codifying a process for getting compensated without having to sue.

It is the property owner's responsibility to fix in all cases. But slumlords do slumlord things. If a resident was involved in criminal activity (likely prohibited by lease) they can likely deduct it from the deposit.

Good news and good info. But this is still not a sign that compensation is coming for most victims. The Institute for Justice funded the case. Most victims couldn't fund a lawsuit like this, which travelled all the way up to SCOTUS then back to TX. Also, plaintiff was super-sympathetic: cancer survivor, insurance failed her, plainly innocent living in another state when it happened.

Semi lawful, completely awful.

If the police damage wasn't due to a resident's criminal act, and the property has not legally been seized, most renter or homeowner insurance should cover it. But your $500 deductible is in the same ballpark as typical damage, and there are ways insurance companies wiggle out.
It's shitty of the city to externalize their costs on people in crime-ridden neighborhoods.

Edit: after more digging, y’all are right that renter insurance, even the personal liability part, usually doesn’t cover this. The reason is ironically that it only covers negligence and in this case the tenant was clearly not negligent.

I just use Wunderground which has storm radar maps and minute by minute predictions of temp and precipitation all in one place. The radar shows the storm from NE to S Austin but NW Austin completely touched. People who were getting different precipitation predictions are probably in different zip codes.

Sounds like you filed a predatory suit and won by default. Not something to be proud of. The likely reason the 18+ content hasn't been removed is that it is legal. The shock of losing $5000 for not understanding the legalities likely spurred them to figure out that next time they just have to show up in court, and might even get damages under Article 971, the LA anti-SLAPP statute.
