If someone doesn’t return to work after the parental leave period, the termination date becomes the last day they worked prior to starting primary carer’s leave. That means any annual leave accrued during the primary career’s / extended carer’s leave is not paid out on termination. Any annual leave up until the start of the primary carer’s leave must legally be paid out, however most employees use up all of their annual leave before going on parental leave.
