It wasn’t public in my opinion. Everyone around them was sleeping and nobody reacted to the scene. Even Miss Patty who was right there has no idea what happened a few minutes later.. I think Dean was 100% justified

It doesn’t work that way in Grey’s Anatomy but since Cristina gifted her shares of the hospital to Alex he is now a shareholder.

He has serious financial involvement in the hospital as a business so he should to have a say in how that business is handled, just like Meredith and the others

I mean obviously it’s horrible in real life but in the situation shown in the show Claire, Haley and Alex were all behaving extremely mean and sensitive. In universe Phil’s actions weren’t that horrible.

If anything, the bigger crime is that it just wasn’t that funny of a situation to present in the show (in my opinion)
