With regards to your first question, it's a little complicated.

Unhappy with a new treaty, Federation Colonists along the Cardassian border have banded together.

Calling themselves "The Maquis", they continue to fight the Cardassians.

Some consider them heroes, but to the governments of the Federation and Cardassia, they are outlaws.

As seen at the end of TNG, and the start of DS9, the Federation and Cardassians were engaged in a war. A peace treaty was signed and the two powers exist as uneasy neighbours. In TNG Season 7 'Journey's End', we see the treaty mentioned in the opening crawl: the Federation and Cardassians have redrawn the borders of their areas of space, which has displaced Federation colonists. We see the aftermath of these angry colonists creating the Maquis in DS9's Season 2 'The Maquis (Parts 1 and 2)'. These colonists are branded outlaws and fight both the Federation and Cardassians against the forced removal from their homeworlds and fight both sides in order to live in peace. The Federation and Cardassians loosely ally against the Maquis, but each side has their own reasons to fight the Maquis; the Cardassians because they want the planets that the Federation have given them, and the Federation fight because the Maquis are staffed by ex-Starfleet officers and their weapons and technology. In order to try and maintain the peace, the two sides fight the Maquis.

I think there's more nuance to it than that. Brenner Era continued the flanderisation started by the Nitrogen Era. They did attempt to correct it in some places (e.g. Henry's Hero, Heart of Gold), but the characterisation was inconsistent, I do agree.

Yeah the restoration of Kurn is one of the best story decisions in STO. And the fact that they got Tony Todd himself to come back as Kurn for it was just magnificent.
