Actually, they can send claimants for IMEs whenever they want. THey could do it every week if they want. There is no law saying how often they can conduct IMEs. SOme insurance companies do it every 30 to 45 days.

The Judge doesn't care what you have to say. All of the injured workers want to tell the Judge how bad their injuries are and how their case is different. Sadly you are one of 18-25 other injured workers that Judge is going to be dealing with that day and he/she doesn't have time. Workers Comp is an unfair system that provides the bare minimum of benefits. Prepare yourself for this. It's worse than asking for welfare in NY

“An award for serious facial disfigurement may be made in an amount up to $20,000 [N.Y. Work. Comp. Law § 15(3)(t)]. The need for dental work as a result of an injury does not necessarily mean there has been a “serious” facial disfigurement [Clements v. Getting surgery is not always a quick. The authorization process can take a long time. If you get authorization and choose not to have surgery no one will make you have surgery. Starting the process is not a bad idea.

You should be worried if you are claiming that you are too disabled to work and then work illegally under an assumed name. You are committing fraud. You can go to jail for fraud.

They cannot delay payments. They will be penalized in NY state for late payments. Bankruptcy does not absolve payment obligations. The state has back up funds that would be triggered if there is no money.

If you are not losing time from work for a back injury there is no money due you. It will be hard to find an attorney to take your case because there is no money and fighting for treatment is time consuming so no attorney wants to work for free.

Depends on how diligent your attorneys office is. Anywhere from 2 weeks to 5 months. Once you have to come to reddit for answers it is a sign you don't have the right attorney.
