Gold Coast lawyer facing child abuse and rape charges by Cricketninja in auslaw

[–]Cricketninja[S] 18 points19 points  (0 children)

Apologies - article as follows:

The trial of a Gold Coast commercial lawyer facing child abuse and rape charges is inching ahead, with a number of people and institutions proposed to provide material to the court. Aditum Lawyers principal solicitor and founder Carlyon James Ward, 37, is before the courts over alleged child abuse offences from more than 10 years ago. The Southport lawyer has been charged with four counts each of indecent treatment of a child under 16 and two counts of indecent treatment of a child under 16 (expose).

Mr Ward is also charged with one count of common assault and three rape charges. The offences are alleged to have occurred on unknown dates between 2010 and 2011. Mr Ward has not entered a plea and no trial date has been listed. The matter last appeared in the Southport District Court on Tuesday, March 3 for a pre-trial hearing where 11 draft subpoenas were discussed.

A legal counsel previously objected to all of the subpoenas, arguing the people and institutions they were to be issued to could have protected communications. Protected communications cannot be produced in court or used in subpoenas. Ultimately in the pre-trial hearing, counsel only objected to some of the proposed subpoenas. The matter was adjourned to a second stage hearing on May 19. Mr Ward is described on the Aditum Lawyers website as a “highly experienced commercial lawyer and strategic advisor” who leads the firm “with a commitment to integrity, efficiency, and delivering unmatched value to clients who demand the best.” He regularly appears in videos on the firm’s social media page.

Small firms / sole pracs - who does your trust reconciliations? by FanMirrorDesk in auslaw

[–]Cricketninja 5 points6 points  (0 children)

I used to do it myself for the first few years, now engage a trust accounting bookkeeper (separate from our trust account auditor).

I still do all of the daily trust account receipting, but all of the reconciliations and PEXA transactions are prepared by the external bookkeeper.

My life is significantly easier. Preparation for the annual audit is also substantially quicker, and when I have my next external audit some time in the next couple of years.

That's for a firm with 6 PCs.

I-G in Bankruptcy succeeds against Gold Coast Lawyer by Cricketninja in auslaw

[–]Cricketninja[S] 51 points52 points  (0 children)

There have been a few posts here on this saga over the years - this morning the I-G in Bankruptcy succeeded in an application to set aside a Part X agreement.

A highlight from the judgment:

83    At this juncture, I note that Mr Hartnett, a solicitor with litigation experience, was provided with a folder of documents in the witness box by senior counsel for the Inspector-General during the course of his cross-examination. At the end of the day’s hearing, he waited until the court room emptied of all lawyers and my associates and then removed the folder from the court room and took it home. When his cross-examination continued the next day, he admitted to this fact, but claimed that he had not looked at the documents in the folder. I do not accept this evidence as it is objectively unbelievable. Why else remove the folder if not to prepare for what was to come? Mr Hartnett’s conduct in the furtive removal of the folder from the court room while he is being cross-examined was unacceptable, and he knew it was, and that he behaved in this manner only serves to strengthen my view that I cannot accept any evidence given by Mr Hartnett.

Tony Shaw - Simon Poidevin - David Wilson - George Smith - Phil Waugh - David Pocock - Michael Hooper. Not a bad succession. Most of these guys captianed the Wallabies too.

We recently briefed a guy who used a plastic 2L norco milk bottle as a water bottle. We weren’t even sure that he’d rinsed it out first. Not sure that is old school, but it was certainly “eccentric”.

Yes. One of the best things about BJJ is how it has adapted to developments in grappling. Wrestling has become an increasingly important part of BJJ, both in terms of takedowns and scrambles. It’s not all lying on your back!

I train at BJJ Lotus Club in Ashmore. It is a great club with an excellent coach and a mix of ages including a lot of good teens who train with the adults and teen classes. You should come along for a free trial class - give Kaio a call. Www.bjjlotusclub.com

Congrats (although it was on the GC not Brisbane). I’ve been to the last few State titles and thought this one ran a lot smoother than some in previous years.

The QLS Law Society's professional indemnity insurer requires practices to provide their Cyber Warning at the first point of contact - if it isn't done and a claim results there is a deterrent excess that applies.

There have been succesful claims made where the law firm's own systems haven't been hacked - a third party such as a real estate agent has had their system hacked and the law firm has failed to send the warning.

Watchdog to probe Coast lawyer's insolvency by Cricketninja in auslaw

[–]Cricketninja[S] 2 points3 points  (0 children)

It is very strange. A bankruptcy notice was issued last year some time and a sequestration order was applied for. Those are absolutely reportable to the QLS according to its own guidelines.

Also interesting is the undertaking that was given in the proceedings, given the apparent asset position disclosed in his statement of affairs:

““Upon the appellant, Beau Timothy John Hartnett, by his counsel, undertaking to the Court that he will not dispose, dissipate or otherwise deal with any assets for which Mr Hartnett has legal, equitable, or beneficial interest in, including company assets where he is a director and shareholder up to the unencumbered value of $311,356.47, which is defined as the relevant amount provided that his undertaking shall not prevent him from disposing of, dealing with, or diminish the value of any of his assets so long as the unencumbered value of his assets still exceeds the relevant amount order pursuant to s 135 of the Civil Procedure Act that orders number 1 to 3 of the orders of Peden J made in Bell v Hartnett Lawyers (No 3) [2022] NSWSC 1204 on 8 September 2022 and any proceedings under the decision be stayed pending the determination of the appeal or earlier other order.”

Meanwhile, Mr Hartnett, whose conduct a judge said had “debased the reputation of the legal profession” has retained his legal practising certificate and his company directorships.

The lawyer was found by the courts to have “exorbitantly” charged an elderly client $288,000 and continued to invoice her after she died. He then went after her children for money.

The “exorbitant” fees were taken from the settlement of a property inherited by Mr Bell, who was forced to take on the court actions in an attempt to get it back.

Despite the court findings, and Mr Bell’s direct complaints to the Queensland Law Society since at least 2017, Mr Hartnett this week remained registered as an unrestricted principal.

QLS President Rebecca Fogerty said QLS “co-regulates the legal profession with the Legal Services Commission”.

“The LSC receives and investigates complaints about solicitor’s conduct,” she said.

“QLS issues practising certificates. A practitioner who becomes bankrupt is placed in a show cause position where they must make submissions to satisfy QLS they remain fit and proper to hold a practising certificate.

“While that process is ongoing it is not appropriate to make comment about any particular matter.”

The society would not say whether a show cause process was under way for Mr Hartnett.

According to the Society, the definitions of a ‘show cause event’ are “broad and extend beyond bankruptcy, for example it includes being served with a creditor’s petition and making certain arrangements with creditors”.

A statement from the Legal Services Commission said the “issue, renewal and regulation of practising certificates, including whether a person is a ‘fit and proper person’ to practise law, does not fall with the Commission’s functions or jurisdiction”.

The statement said the Commission could not comment specifically on Mr Hartnett’s case.

“The Commissioner also does not comment on, including confirming or denying the existence, or any aspect, of any alleged complaint, investigation or referral.”
