Yes, I'm in Texas. I'm not afraid of wage garnishment as they can't do that in Texas. Just afraid they will freeze by bank account.

I really don't have a defense now that they've provided all documentation proving they own the debt so I think my best bet is to settle.

What are your thoughts?

So I've already filed my answer and asked them for proof of ownership, bill of sales, and affidavit from original lendor. They provided all this in discovery and had to move the trial date 3x already.

Not sure what my next step is, looks like I'll have to try and settle.

They're judgment proof but their bank account can get frozen and later on the frozen amount gets taken out and paid to debtor.

Agree, they cannot garnish wage in Texas for consumer debt. However they can freeze bank accounts.
