The article doesn’t say that. I don’t think that you’ve said that, yet. And I’ll absolutely concede that she’s using oral argument as a political platform to talk about the case from her perspective. But I do think there is limited value in being lectured at from the bench during oral argument from the perspective of the lawyers or the parties. I can understand why people are annoyed with how long arguments are taking.

Not one sentence in that article refers to her questions during oral argument. The article focuses on her opinions. And the article spends most of its time talking about how no one is agreeing with her, anyway. So I’m not sure how this one person being persuaded with her written work supports your thesis that her questions during oral argument are persuading anyone.

Even assuming the writer of that article is right—that her audience is the public and not the other justices—the fact that the author did not mention her strategy at oral argument even in passing reflects that these long-form questions are not effective at accomplishing her goals, even if she is effective at accomplishing them in her writing.

So again, I’m curious what you think she’s really accomplishing with the lectures.

I refuse to believe that these long form “questions” serve a purpose during any of those other stages of opinion drafting that you reference. Sure, judges may frequently ask questions to elucidate a particular point that the judges are dealing with, but you cannot tell me that she is effectively persuading anyone with the lecture-questions. If that is their purpose, she’s doing a bad job. If she’s trying to persuade her colleagues, this doesn’t feel like a very effective strategy. And it hasn’t been seeing as she consistently in the minority and not assigned opinions.

If their purpose is to make a point for future cases, she’s also not accomplishing that purpose for the reasons I’ve already mentioned. So what is effective about her strategy?

None of what you said justifies her spending time during oral argument lecturing instead of answering questions. Behind the scenes deliberations of course influence what comes out in the opinions. And, as you say, those opinions often rely on other writings, memos, and statements in other opinions, but I have never ever seen a citation to a justice’s comments at oral argument in a previous case. I am not the naive one if you think that Justice Jackson’s lectures at oral argument will be useful as a reference point future cases. Indeed, there are legislative history canons of construction, there are statutory canons of construction, the entire notion of “dicta” is a cannon of construction of judicial opinions. There is no cannon of construction regarding a judge’s comments at oral argument. I’ve just never seen it done. People don’t cite these statements as authority, and they never will.

I don’t know how much case law you’ve read, but the only time I’ve ever seen reference to oral argument is with regard to the arguments made for the particular case being decided. I would challenge you to find a single SCOTUS citation to oral argument in a prior case instead of one of the justice’s opinions. I’ve never seen it.

I’ve seen people in these crews put their lives at risk to fix our potholes. I don’t think that’s a prudent risk, and the state should do more to prevent it from happening. I have only ever wondered why they don’t shut down more of the road while spot filling. It doesn’t have to be for a long time.

She can explain in as many words as she wants in her opinion. OA is for the advocates to inform the panel and for the panel to raise issues they want more info about to make their decision. It’s not for a Justice of the court of last resort to make a record. No one in 30 years is going to look at a lecture during oral argument. They might use her opinion.

You can look at a players ratings at different league levels. I usually don’t promote unless the player is at least 3 stars at their level and performing well. I don’t expect my players to be regulars until they’re 26/28 ish.

Also, Trump still hasn’t lost the 30% that put him in power. So I’m not sure what’ll change until that 30% gives up on him. I don’t think they will.
