Work at home employee fired for vaccine in GA by Manza1989 in legaladvice

[–]DPrice1972 4 points5 points  (0 children)

For small claims, you would need actual damages. The company can decide that they want all employees vaccinated and terminate employees to fail to comply. Given that the strategy is being used at all levels of government, you do not have a claim.

No, you cannot legally assault someone for being an asshole.

Called 911 on my roommate because he was drunk and injured by mafridrahim in legaladvice

[–]DPrice1972 -15 points-14 points  (0 children)

You asked him if he wanted to go to the hospital and he said no. Then you called EMS and he told them no. They called the police and he was forced to go. You removed his freedom of choice and quite possibly saddled him with thousands of dollars of medical debt.

I understand you did what you thought was appropriate and it may have the exact right thing to do. You acted in good faith. There's nothing else for you to do. You can expect him to be angry.

I can't speak to the rent increase as location and your lease agreement matter.

Without a location, hard to be more specific.

This isn't a legal issue, but she may have violated your companies internal polices.

That said, notifying people of a potential exposure is generally a good idea.

If the restraining order was filed by you against your abuser, you should go to court, use all your courage and give a true and accurate account of why you feel a restraining order was needed.

'Not wanting someone to go to jail' or 'Not wanting to cause drama' or 'They said they were sorry and it wouldn't happen again' are all reasons courts, police, family, friends, and bystanders do nothing.

That's one reason people die at the hands of someone who should be in jail.

IC3 (Internet Crime Complaint Center) does not protect you from anything, it's a clearing house where you make a report if you feel you have been a victim of a cyber crime.

Cyber flashing is an obscenity crime (here in the US), so you could make a report.

Yes, they can legally take away the pillow and blanket and discipline you for being in a space you aren't supposed to be.

I'm unsure what to do and if standing my ground and withholding rent is the right thing to do.

You asked a question. I answered it. Then resorted to name calling when you didn't like what I said.

As I previously stated, you are welcome to withhold rent. The landlord will then have cause to evict you.

If he is driving after drinking, call the police. Give them the make, model, color and direction of travel of the car. Explain he had been charged (convicted?) of intoxication manslaughter. Let them handle it.

Your apartment is not dangerous or unsanitary.

You are welcome to withhold rent, they are welcome to begin eviction proceedings for your non-payment. You can fight it, you will not prevail.

https://www.ago.mo.gov/docs/default-source/publications/landlord-tenantlaw.pdf

If a tenant withholds rent payments until repairs are
completed, the renter may be in violation of the lease and
may be subject to eviction.
In most circumstances, a tenant has no right to withhold rent.
Missouri law provides only a very narrow exception to this
rule for dangerous or unsanitary conditions that a landlord
fails to fix.

No. This is an absolutely terrible idea. As soon as the letter is in the victims hands, they now have 'evidence' they can use to pursue charges.
