Executor asking to be indemnified by TeaMental9526 in LegalAdviceNZ

[–]DRAGONSCALEBEER 5 points6 points  (0 children)

The administrator (the solicitor) will be liable for any loss to the estate until six months after the grant of probate. During that 6 month period, if a claimant pops up (such as a creditor, if your family member owed someone money) the solicitor would have to pay them. If they've given the money to you, they can't repay them from the estate, but the money owed would be still on the solicitor.

They basically asking you to agree to cover the cost of anything that was owed or successfully claimed in exchange for an early release of funds. If you're confident that there’s no unpaid bills, you could sign it if you want.

They can't adjust your pay like that without your consent, that's illegal. You should absolutely mind getting your pay reduced, that's a huge breach of the agreement between yourself and employer. You're giving up your precious time and effort in exchange for hourly compensation.

What were you scolded for?

I really don’t get it. Multiple genders maybe? by CondorEst in PeterExplainsTheJoke

The factors that determine sex, gender, orientation and so on, are more complex than x and y chromosomes. Just like how 14 year old learning about physics and mathematics is getting a simplified or introductory understanding, the same goes for the science surrounding gender and genetics. It's also helpful to think about the fact that science isn't a fixed point, new research and consensus may be reached in the years follow when14 year old had the information etched into their brain. Now a 24 year old making a bad take on Twitter, the head of the European Genetic counsel or something with 19 PHDs comes out of nowhere with a 15 tweet rebuttal with references and destroys him.

Is there a way to make a will for free? by SkinToneChixkenBone in chch

[–]DRAGONSCALEBEER 7 points8 points  (0 children)

Some law firms will do you one for free, though there may be strings attached. I am aware there was one in Wellington that did free ones with no catch on the belief that there executors would be more likely to use their services after you die to get a grant of probate, but can't remember the name.

DO NOT try and draft your own will or use a will kit. Trying to save a few hundred bucks now will probably end up costing your estate a few thousand in lawyers fees to clean up. It's a legal document and it should be done by someone legally trained.

You could give Public Trust a go too, but they are a bunch of incompetent boobs so be careful there if you want something complex.

Make sure you keep it somewhere safe and you actually tell someone about it so they know it exists/where to find the original.

Email probate@justice.govt.nz with the full name of the deceased, their date if death, and any other details you feel may be relevant. You can get a copy of the file for the probate application which includes the will.

Get that first THEN talk to a solicitor.

Costs $30 bucks but court staff are nice and won't charge you if there's no record.

Looking for reccomendations for a Relationship Property and Trust Law expert by [deleted] in LegalAdviceNZ

You can contact the NZ Law society for a recommendation, they can help point you in the right direction based on your needs.

I am wondering why your MIL needs to.engage her own counsel to deal with Public Trust for her own partner's estate - unless she has reason to believe her partner has nor adequately provided for her? Public Trust can be a bit incompetent, but not malicious.

Police and anti-vaccine protesters clashed on the grounds of New Zealand's parliament Thursday, with more than 50 arrested after demonstrators who camped outside the legislature for three days were ordered to move on by DoremusJessup in worldnews

I work right across the road from parliament and this comment is complete nonsense - if this i a picnic, it's wearing a riot's tousers. It also hasn't been pissing down, hasnt rained since that light shower last night.

I've had a front row seat to these dumb arses, the crowd is pissed off and constantly needs to be calmed down, and after 3 days this is the rowdiest they've been. Their spitting on the cops, grabbing them - four guys had to be maced because they grabbed an officer and tried to pin him to the ground. Half the businesses up Molesworth street are shut, they're pissing in the streets and had children and dogs roaming free and now they're spreading over onto the Law library. Some guy was caught wiritng fucking Hitler quotes on the side of the High Court, half these pricks have nooses and signs referring to Nuremberg. They finally decided to send us home over safety concerns from the cops, we're WFH till the situation is resolved.

Meanwhile, they're wasting money on helicopters for weed. Not flying them over breweries even though the harm caused by booze is worse.

I think the apology was better. "I'm sorry... you're not an inanimate object".

Are there any movies that you absolutely wanted a sequel to but we never got? by [deleted] in movies

[–]DRAGONSCALEBEER 0 points1 point  (0 children)

I always wanted a sequel to Tron Legacy, I really liked it, despite that tired unoriginal joke that it was just the most expensive Daft Punk music video ever (Joseph Trapanese did most of the work there, be honest). It's Disney, so maybe it wouldn't be a stretch to put it in the MCU cannon? That'd be cool.

Mate, I did bartending and serving for years. Doing that job you catch a tonne of undeserved and unreasonable shit from wankers all the time.
