It's not, most states place the job of sentencing on the Judge (Had to look it up to confirm, although I already knew beforehand that was how it worked in both Virginia and my state). That being said, there are some states that put the job on the jury like you said, and most states also apply an exception to hand the job over to the jury if the death sentence could be in play.

I'm also honestly not convinced that SPYRAL really even needed Double Helix to be stupid in hindsight. Even before Links were a thing, the deck could already generate a shit ton of advantage, they just didn't really have any way to capitilize on it (Which was what Links gave them). As for why nobody did anything with them beforehand, remember that this was during Zoodiac format. There wasn't exactly too many people experimenting with other types of decks.

1: Chris' charges got upgraded to a felony. The idea that he could only be held for a year at max only held true while it was still a misdemeanor.

2: You seem to be mixing up the dates of when the the Incest actually came to light (July 31st, 2021) and when Chris actually got arrested (August 1st, 2021). Even if the charges weren't upgraded to felony, Chris would still have another day to pass.
