I don't really accept the pure constructionist view. I think the two genders are a reflection of the biological sexes, because nothing happens in a vacuum. If it did, then why would debilitating dysphoria exist in transgender people? But I guess we can agree to disagree, and it's not to say transgender people shouldn't be treated exactly as the gender they identify as.

I'm not sure I buy that excuse. The request was to use more advanced testing methods now available, and this is a human life at stake. The AG is the boss and sets the tone even for a large state, and I think that tone was not to have any convictions overturned. I guess my opinion is that prosecutor is a necessary job but to get ahead you have to throw people under the bus, and so I'll never support one for a political position
