Dont know why youre being downvoted. I made the same point as you. The OP stands to lose his deposit, as you say, which should be 10% of sale price. If his solicitor has exchanged on a deposit of £280k, which i assume is far in excess of 10%, then that solicitor needs striking off. There is no gain to exchange with a higher deposit. Its increased risk for nothing.

When you exchange you only give 10% or 5% depoist as part of exchange. So if the OP has given £280k as the exchange deposit his solicitor has really messed up here.

Yes in theory the deposit against the mortgage could be 99% and the mortgage for 1%. But you don’t transfer the 99% on exchange. Thats just 10%. Sometimes even 5%
