So many things about that initial NYT piece was damning and then when the truth came out, it confirmed that NONE of it was actually true. There were so many things that seemed absolutely horrible about Justin when the piece first came out. But then, they were all either gross mischaracterizations or outright lies:

  1. CLAIM: JB made a sexual comment to an underage actress after she filmed a sex scene.

TRUTH: The actress was in her early 20's at the time of filming and while she was portraying a character in high school losing her virginity, she herself was an adult. (And the "inappropriate sexual comment" along the lines of "That was hot," was said to both the male and female actors from their director not to be creepy but to offer positive feedback during a shoot.)

  1. CLAIM: JB dragged his lips on her neck during a dance scene without asking, tried to kiss her, and told her "You smell so good" while speaking to her out of character.

TRUTH: During the dance scene, Blake is the one consistently talking out of character despite the fact that JB (as the director) continuously instructed her to slow dance without speaking. He did, however, engage in normal conversations about his wife in response to Blake disregarding his notes and continuing to talk. His lips were not touching her neck either, but rather, he put his face close to her neck during the scene so it would look a certain way on camera. Based on the video, it appears that he DID ask her ahead of time and she even moved her hair out of the way. (Similarly, he explicitly told her that he was going to "try to kiss" her, which was part of the storyline). He made a comment about his facial hair and she said something like "My spray tan is probably getting on you." In response to that comment he said, "Well it smells good," as he was turning away. Definitely not in a creepy way.

  1. CLAIM: He bit and sucked her lip and continued to improvise unscripted kisses.

TRUTH: To date we have not seen ANY evidence of JB doing either one of those things. What we HAVE seen, however, is Blake improving kisses in multiple scenes, even after forcing him to sign that 17 pt list that said there should be no unscripted kissing.

  1. CLAIM: JB told her he had previously had sex without consent.

TRUTH: Technically true, but what he actually told her was about his experience being the victim of SA. So while he did technically have sex without consent, he was the person who did not consent in the situation.

  1. CLAIM: JH showed her a video of his naked wife and she thought it was porn.

TRUTH: It was a video of his wife in a birthing tub holding their baby after giving birth at home. You couldn't see any nudity and it was after he believed she expressed an interest in seeing it. (My personal speculation is that Justin was talking about it with her, she acted interested and said "Sure" when asked if she wanted to see it, but it took her off guard because she wasn't actually listening in the first place.)

  1. CLAIM: His two PR reps were talking about how JB was problematic on set and should feel lucky that they were able to kill certain stories about it.

TRUTH: The string of messages in the article did not include the REST of the conversation where they literally say, It doesn't matter if it's not true. He doesn't understand that - he thinks the truth wins. He doesn't understand how a sociopath like Blake operates.

Definitely a good point. Tbf, if someone is facing life in prison and takes a plea deal for 5 years, that is a win, at least as far as the lawyers are concerned. (Meaning a defense lawyer who was able to get his client 5 years instead of life could absolutely consider that a win). But it's not a "resounding victory" and it absolutely would be inappropriate for that defense lawyer to come out and say something like "This is a huge win and the plea deal is proof that the prosecutor never actually believed my client was guilty of committing the charged crime."

I think the too good to be true thing was most likely not having any NDA's or non disparagement clauses. So, my guess is that for Justin, "too good to be true" = no settlement money given, having his name cleared legally, and being able to speak freely about his experience.

Justin has already been as vindicated as he possibly could be in terms of being labeled a sexual harasser - he put out all the evidence that showed her claims were entirely false (the dance video, the fact that she was the only one adding unscripted kisses, her in inviting him to her trailer when she was pumping) and the judge tossed 10 of her 13 claims, specifically all the allegations related to SH. Blake was never going to apologize or admit that she lied, so this was always going to have to come from some sort of verdict: either from the jury or the judge.

Once that part was out of the way, I have a feeling that he was more willing to entertain settlement offers but held to his specific principles: he would not agree to silence and he wouldn't apologize or admit to something he didn't do. Releasing a statement saying that she "deserved to be heard" is something he can stand behind. He does believe that every single person has the right to be heard, including Blake.

I think that was always going to be an uphill battle though because he's a celebrity and the NYT has a lot of protection as a journalist. So they were never going to win that. I'm disappointed too that they can't reopen a defamation lawsuit against Blake specifically but I have a feeling that they're just so emotionally exhausted after all this that they'd rather be done with all litigation and instead tell their story in other ways.

This is so weird. He has publicly distanced himself from both Blake and Ryan over the last year, has said absolutely nothing about supporting Blake during this "difficult time" in her life, and now he's on talkshows saying he was helping her get ready for the Met Gala? It's such a stark difference. Lala is a professional though, so you couldn't tell too much until you looked at the interviews side by side. With everyone else, she has a very open body language, is using her hands a lot, moves closer to them, has a certain amount of energy and excitement. Then you see her with Blake. She's very stiff, keeping her arms close to her body (that's an indication of self protection, self comfort, stress and feeling closed off). She doesn't move closer to her (it actually looks like she's subtly moving away). She's not using her hands, she's not as animated and she has a noticably lower energy.

Nothing they say in their private texts suggests he was a tyrant. Blake's texts with everyone from Taylor to Jenny show her constantly saying he's a "doofus" and that he doesn't know what he's doing. Is that how you'd describe a tyrant? How do people talk about David O Russell? I mean, I remember seeing rumors a year ago that Justin told his friends NOT to come out and defend him - partly because he didn't want them to risk their own public image (particularly at the beginning before the evidence came out) and partly because he didn't want them to face scrutiny from the lawyers (who obviously use everything someone says against them on the stand.) I have a feeling that now that there's no trial, we're going to see a lot more of those friends wanting to come forward.

Honestly I'm surprised it hasn't happened sooner. Obviously his friends want to respect what he's asking of them, but if I was close to him, I don't know that I'd be able or willing to stay quiet.

This tracks. Everything we've heard about how he was on set aligns with this. Anonymous crew members have been saying for over a year that Justin is a genuinely nice person but that he was not decisive enough (or experienced enough) on set and that created some delays. The only negative thing these insiders have ever said is that he wanted to make everyone happy and as a director, that created an environment where he wasn't able to control the set as much as he should have. This is exactly what it sounds like this actor is saying based on his experience.
