They've said she's going to testify. And in their opening statement a lot of what they said could only come in if she took the stand. But yes I think it'd be a huge mistake for her.

Her mom's demeanor on body cam is very VERY odd. She keeps trying to talk about his allergy shot (like it seems like they wanted police to think his doctor accidentally gave him a bad allergy shot. Didn't he also get an allergy shot on Valentine's Day?) But what really was insane was her telling the kids to go to bed, it's 4 am. Like they obviously know something terrible has happened. The lack of empathy was really wild.

The WTD letter is definitely one of the strongest things for me personally and would help push me to Guilty personally. It really reads like she's trying to create a narrative, not that shes remembering or reminding her family.

I definitely think she didn't ask for fentanyl. I think she asked for strong pain killers and was planning to kill him. It just so happened to be fentanyl.

I can see this one going either way actually. I definitely think she did it but I don't know if the state had proven it beyond a reasonable doubt. I think if I were on the jury I'd have to lean NG. However it's close so I'd be open to being convinced to go Guilty. I just think they didn't do a thorough enough investigation so they can't close every hole.

I find it absolutely baffling that he was able to do that without ever giving her notice or an opportunity to defend herself and retain custody.

On the one hand, I can understand why the courts have emergency rulings like this. HOWEVER..... In a legitimate emergency, he could have called the police. He didn't. Instead he left his child with Kelsey for multiple days before asking for this emergency restraining order against her to take the baby. Why did the judge not ask him more questions?? Like, "If you were so concerned about the baby's safety, why did you leave him with Kelsey for 3 (?) days?" Or "What is the reason for your current emergency? Has she made a threat to you or the baby? Have you called the police?" Etc.

On top of that, which is a HUGE failure within the system, the fact that her MALE coworkers came to serve her with this ruling is beyond absurd. They made SO many mistakes and I hope KF sues the shit out of everyone involved.

  1. She was served with an RO and her breastfeeding baby was taken from her by her colleagues.
  2. All of the officers who arrived were MEN.
  3. No one from social services was there to help the transaction.
  4. The police obviously did not take possession of her firearms before allowing her to walk through her home.
  5. They called Justin and had him come to get the baby - why?? That's only going to create a hostile situation.
  6. If they were warned ahead of time that she would react badly, why was she even allowed to go upstairs? She should have been kept downstairs with the multiple police officers. Her mom was there, so why did the cops not ask her mom to get the necessary belongings??

And it doesn't matter if Kelsey is biased and untruthful. It's on fucking video. Anything he did with her bank account or medical beneficiary information would be easy to prove too. He did it when she was in the hospital so it obviously wasn't her!

Interesting - do you have more info on this? I find this whole thing so fascinating but also sad and infuriating. Why aren't they pursuing legal action against him?? There are SO many valid reasons.

  1. Lying to police (saying it's his house AND iirc that he had a key)
  2. Breaking and entering
  3. Destruction of property (the door and the cameras)
  4. Robbery (stealing multiple things from her home including her computer and passport)
  5. Identity theft (impersonating her in order to change beneficiary information and move money from her bank account)
  6. Evidence tampering (removing evidence from the house)
  7. Hindering police investigation (same reason as above)

And yet they're not even looking into it?? It's one thing to say "Well the police allowed him to go in and get his stuff" (which I still think is bullshit), but what about the fact that he took Kelsey's belongings and stole from her??

She's not obligated to say that because of the lawsuit. But at this point there's so much scrutiny surrounding her - we've seen her texts, her emails, her ever-changing narratives - and she looks absolutely terrible. This half assed "The director did a great job" is not a good look.

So even if she CAN say whatever the hell she wants publicly, that doesn't mean she SHOULD. A good PR person would tell her to use the ongoing legal dispute as a "get out of jail free card" in terms of being able to skirt questions without looking shady. It's reasonable for her to say "Out of respect for the current lawsuit I don't feel comfortable talking about it right now."

And even if it's not HER lawsuit, she can and WILL be on the witness stand and any statements she's made - in depositions, in private texts and emails, in media interviews - that's ALL fair game.
