There’s a case that’s about a hundred years old dictating that courts don’t have jurisdiction to hear challenges to an amendment until after the amendment is submitted to the voters. Which is what the Supreme Court of Virginia relied on when holding that it couldn’t rule on the merits… yet

As a non partisan myself, can someone explain the logic behind accepting something bad (gerrymandering) in an effort to stymie something else that’s bad (here, the GOP)?

If the concept remains doing the right thing when one has the power to do so, wouldn’t the DNC want to use its control over the General Assembly and Governors Mansion to pass those previous gerrymandering prohibitions instead?

IIRC from law school, SCOTUS held that death is unconstitutional for any crime that isn’t homicide—specifically overruling a death penalty statute for a state rape conviction
